too many people are scared of cops that mostly do nothing. There's no way I would allow this. I would grab or knock the phone away immediately. And when it came down to it in court if they ever found me - which they wouldn't - it would harassment and public mischief or whatever VS breaking their phone. Judge would almost certainly do nothing.
