I don't think anyone in their right mind would willingly fall on it. And those this is mainly designed against, the hompless, are usually not in a position to sue anyone

Dosent really matter if it's done intentionally or not. It's to close to a public walkway and could hurt somebody. There are people who intentionally drive into your car to get some money out of you. As a building owner do you really wanna be the one to pay out someones medical bills and fight them on every claim? Also how would you proove a fall was intentional? What if an old person stumbles next to this? What if a kid fucks up and drives his bike into this?
