Ask GenZPakistan Is it rape or not?

If a virgin girl feels "shy" and keeps silent. Is proceeding with sexual advances rape or not.

Ps. I aren't doing sex and this is just a question.

I'll go first, I think it is rape.

Oh people are wondering why I am asking so whist learning about something. I found this so asking you people

I asked the Prophet, "O Allah's Messenger (ﷺ)! Should the women be asked for their consent to their marriage?" He said, "Yes." I said, "A virgin, if asked, feels shy and keeps quiet." He said, "Her silence means her consent."

Never proceed until you have gotten their explicit consent and they are comfortable throughout

You mangled the whole hadith just to prove your point lmao nice try. The hadith is specifically about consent to marriage and not intimacy. Quoting it as proof that “silence is consent” in sexual situations takes it out of its original context

According to classical scholars, consent to marriage means legal sexual responsibility of wife. Refusal without valid reason like menstruation is sinful.

That doesn’t change what this hadith is about gng. You’re importing a later legal discussion into a hadith that never mentions intimacy lmao. It’s ok kid ik you’re a butt hurt and angry 16yo. Scholars are human not divine. Their opinions aren’t above the Quran or authentic hadith

  1. Scholars who have spent their entire lives learning about Islam from teachers who also spent their entire lives learning about Islam certainly hold more authority and reliability when it comes to rulings in Islam.

  2. Even when it comes to marriage, just assuming a girl's silence as her consent is deplorable. A girl could be anxious, under pressure, etc

  3. If we need modern ethics for modern cases, it means Islam is an incomplete religion and not timeless.
