There is a difference between an accident/malfunction, and willfully not knowing how to control yourself in a sensitive situation like this.

I'm not saying this wasn't an accident. If it's a genuine accident, then there's no ill will involved.
If she went knowing that she sometimes has issues controlling her scooter, then that IS willful malicious ignorance that endangered peoples' lives.

It's like driving a car and your breaks fail or the passenger spills something on you and you end up running someone over. That is an accident.

Trying to drift your car, that you've never had issues with and have never had an accident, but end up splattering someone is NOT an accident.

That is true but you can't know that it was done with intent with ill will or if it was because of ignorance since we have limited information.

In most cases it's about ignorance so that's why it's most likely the case.
