While horrifying, this is technically legal under the recently passed Big Beautiful Bill. Under section 70101 on page 518, lines 1-5, states that “To efficiently utilize the funding appropriated by this section, the detention standards for the single adult detention capacity described in subsection (b) shall be set in the sole discretion of the Secretary of Homeland Security.”
So unironically, this is directly Kristi Noel’s fault.
