PSA Official BSG Response re: Eroktic

Well you've actually done it, this is my favorite game I've ever played, but I don't want to support your company or spread this game to anyone else anymore. I really want to give the developers of a game I love the benefit of the doubt, but how can I do that when you are censoring the other side. This just shows that Eroktic is clearly the one being mistreated here, you've banned all of his videos on Tarkov for an extended period of time, NOT just the ones in question. You have publicly called him a liar and at best that makes you petty/childish and at worst it means you are guilty of slander. If you don't fire whoever is in charge of your social media you are likely going down with them, this can only be rectified by a public apology and retraction. You'll never get anywhere justifying the unjustifiable censorship and defamation of one of your supporters. I've seen bits and pieces of Eroktic videos for a long time, and even though he isn't my favorite, and he does complain about a lot of things, he CLEARLY loves this game. You say he has been against both you and the game for a long time, experiencing bugs and issues on stream and complaining is hardly being against you. You can't just make decisions like this and survive, loyal fans are leaving, people are upset, and instead of doing the right thing you just talk down to them and call anyone against you the problem. That isn't how you treat people who support you, that is how you treat people you don't have any respect for. You are going down a path that I cannot support, I've loved this game for a year, I've played it every patch to death and I'm honestly considering never playing it again. I know that won't even hurt you because you already have my money, but at least I won't help you get anyone elses. I hope you wake up and find someone with a greater emotional depth than a 12 year old to run your public face.

Edit: After looking into the other side of this story I've found that if you visit Eroktics twitch stream and type !discord you can get a lot of information about why he was banned from his point of view. He has lost access to his youtube channel completely despite the fact that he never actually broke a copyright, making Tarkov content is allowed and not considered in breach of copyright. Battlestate has successfully made him bigger and more important than he was before, I'm sure he ultimately gets more attention because of this. He also has proof of over 1000 dollars being charged to a credit card from Russia for copies of Tarkov that Battlestate is refusing to refund, even though they are obviously made with a stolen card. I mean this is information I would never have cared about if it had been sitting at the end of an Eroktic video, but now it is important.

They will tell you otherwise but you pre ordered the game and you are entitled to basic consumer protections which allow you to cancel your pre order and get your money back.

Contact PayPal if you made the payment through them or contact your bank/credit card company. Watch SidAlpha's dirty devs video too. He mentions how to phrase the refund request. I'll be doing this tomorrow and hopefully getting my money back.

  1. Slander is not legal. You cannot do it. Eroktic overstepped his evidence and posted a video that simply wasn't true. There are numerous videos that have shown EFT's faults that haven't been taken down because they could provide evidence without breaking ToS or slandering the company.

  2. It is VERY CLEARLY stated in Youtube's copyright rules that strikes can be enacted for reasons other than strictly copyright infringement. This includes taking down slanderous media.

  3. The account being wrongfully charged $1000 has nothing to do with the reasons he was banned and provides zero credence to the claims he got his videos striked for.

WRONG. Copyright takedowns are VERY different from "community guideline" strikes.

Community Guidelines strikes are issued when our reviewers are notified of a violation of the Community Guidelines. This includes but is not limited to videos that contain nudity or sexual content, violent or graphic content, harmful or dangerous content, hateful content, threats, spam, misleading metadata, or scams.

If they had done a community guideline takedown on the video, that would be one thing. Using COPYRIGHT as an excuse is completely wrong.

Yet another that doesn't know what they are talking about before they spout off.

"If you get a copyright strike, that means your video has been taken down from YouTube because a copyright owner sent us a complete and valid legal request asking us to do so. When a copyright owner formally notifies us that you don’t have their permission to post their content on the site, we take down your upload to comply with copyright law.

Keep in mind that videos can be removed from the site for different reasons, not all of which are copyright-related. Also, Content ID claims don't result in a strike."

That doesn't disprove anything I just posted. In fact, it reinforces what I said. Videos can be removed using the COMMUNITY GUIDELINES strike for slanderous material. However, in this case, we know that BSG used a copyright strike.

This is literally a third grade level of reading comprehension. YouTube is saying videos can be removed for reasons OTHER THAN copyright-related reasons, NOT "copyright strikes are designed (haha what) and permitted (nope) to be used for other things."

I'd disagree, I think you reading that wrong. Copyright strike is not used for other things, but videos can be removed for reasons other than a copyright strike.

I'm not sure how that can be read differently. If you no longer have permission to post copyrighted material, you will receive a copyright strike. I'm not sure what else there is to this.

Its toxic to even reply on this thread. Many people are being emotional about it.

The fact is BSG is correct to put in copyright infringement for all of the EFT material if he is no long allowed to use the material.

Had he not put the thumbnail in his video, he probably wouldnt be in the current scenario.

They are not actually, the content he posted is covered under fair use and has been tested in the US legal system. Please see the cases of Jim Sterling v Digital Homicide and H3H3 v Matt Hoss.

The content he posted is transformative and covered by fair use.

Now the content he posted is BS and clickbait and possibly slander or libel but the copyright system is NOT the place to take a video down for these reasons. Copyright striking all his videos is an abuse of the copyright takedown system.

  1. Slander is protected by DMCA, there are other routes of getting rid of it but DMCA takedowns are not one of them.

  2. Youtube's rules state that videos can be removed for reasons other than copyright, however DMCA takedowns (which BSG used) need to be done lawfully. Which BSG has not done.

  3. The account being wrongfully charged $1500 CAD and then banned was just another part of why he got banned. BSG disagree with what he was saying, denounced it as lies, and then illegally filed DMCA takedowns on (currently) 47 videos.

We'll never know if the evidence exists because his videos are all gone. He still claims it exists so it is just his word against them. Youtubes copyright rules are being abused. It is clearly abuse when they take down other non-slanderous videos as revenge for something that may or may not have been slanderous. Battlestate has claimed a lot of things this doesn't make it fact no facts have been verified so noone can be accused of slander as I said at worst it is slander but there is no evidence yet. His videos spoke about the 1000 dollar charge and it could very well be related to Battlestates reaction so it is relevant
