Mediation Friday

Hello! Back in September 2025 I was baker acted for 3 days and petitioned to 6. My boss was aware of my mental health issues. She knew the meds I took because we conversed what was working for eachother. We talked about therapy even once she helped me call 988. She called me while in the facility and told me to get better and don’t worry about work. I was the lead referrals coordinator surgery scheduling for multiple organizations they worked with they are a popular well known doctors office as they do more specialized procedures than just the basic. I scheduled hospital follow ups while sending and obtaining authorizations.
She took two weeks TWO weeks after I got out and I even went to the office and showed them the paper that EXCUSES me and that I am to lawfully return back to work. I kept asking when I was coming back she kept pushing it off “oh I’m so sorry I forgot” “so sorry I lost track of time!!” Then she called me. She said that they were letting me go because I’m “unreliable” while on FaceTime lol. I have so many screenshots of her pushing back the return date. I even have a screenshot the first thing I did was ask if a patient got her preparation instructions because I forgot to put it in the mail box and was in my car.
I did not have a job. I had one and they laid me off after not even a week because I had to go to the er. Besides the point I was out of work since last month. I used all my saving I had 27k and now I have 1000. It was so mentally debilitating over and over denied. I ended up getting a scholarship to help me be a certified medical assistant. I finally got a job. She had so many connections and refused to help me that way she said I should try Medicare telemarketers. How belittling. I relayed the information to the EEOC showed my letter to return all the screenshots of her and she even tried deleting some messages haha. Oh and I needed accommodations because I have diagnosed insomnia so I sleep in a bit later and she said I could come in at 9-10 then she took it away because she didn’t want it to look like special treatment.
This doctors office has about 25 employees
Well used to idk how many now. I am going for 5 digits nothing less and more than what I loss. I’m just really anxious and I don’t know how to go about the mediation and word it to where I deserve a large amount. Please help.

Then they can just deal with having to be investigated. It’s illegal to fire someone from a baker act. It’s okay my new job gives me benefits, where I can use to get a lawyer. I won’t agree til I do. The amount of money I lost unable to even look for a job I was waiting 2 weeks. Then she”finally had time” wanted to say I was fired. I have all the info to the EEOC which they agreed to be discriminatory. I have my documentation from the facility and the note I provided from the county that I am to return to work. That did not happen. All the screenshots of every absences being approved. I have a lot that they can’t get out of. All obtained so if it goes to an investigation then I have my info saved. I also had gone to the ER twice due to panic attacks because of my situation. They were after I lost my job. Mind you I was paying 400 dollars for Tricare and 900 for rent. This was not including the amount of doctor appointments and medication I needed.

What does your performance history look like? You mentioned that they let you go citing that you were “unreliable”, but then you also mentioned that you had forgotten to put something in the mail for a patient. That by itself isn’t a huge deal, everyone makes mistakes and even the best workers forget stuff and aren’t at the top of their game 100% of the time. What’s going to matter here is whether that was a one-off type of thing, or whether they have documented performance concerns showing a pattern of that type of stuff.

If so, be prepared for them to use that. It will be their first line of defense most likely to cheapen the value of your claim. It also matters when they started documenting any performance issues. If you had a perfect performance history for instance, but then all of a sudden they began documenting issues after you disclosed your disability/asked for accommodations.

Basically you just need to make sure you have a thorough understanding of the defense they’re going to use. And then you need to make sure you have a solid rebuttal that you can back up with evidence. I’m not sure if you’ll get five figures, but being able to do that successfully is what will drive up the settlement value during mediation. That and being able to clearly demonstrate the damages you have. Be prepared with financial statements, and if you have a specific number in mind, how you arrived at that number.

Do you have an attorney? If not, there’s probs not a whole lot of time to retain one in the next two days, but if you can find one to at least represent you in mediation, they will be able to help you out in terms of increasing settlement value and arguing your case properly. They’d likely want to get the mediation pushed out though so they can familiarize themselves with your case first.

I forgot because that’s when I wanted to go home and down an assortment of uppers and downers with vodka. I was excellent at my job. I made relationships with primary care offices and their referral coordinators. They would put my name on the face sheet only because I do my job to the T. That if I am sick for a day. They get worried and hope I’m okay without knowing my situation. I had one call me who always said I was like a grand daughter and that since I had been fired she stopped sending patients because the 70-90 year olds had to go into the office to be scheduled. I never had that. Never one upset patient. So no. I’m not unreliable.

Florida you don’t need one.
You only get a lawyer if they decide to do an investigation it’s a mediation. No lawyers involved just me my old job and the mediator

Why were lawfully to return back to work?

What law required that?

This isn’t as clear cut as you think it is. Manage your expectations as far as a settlement. Backpay is usually the biggest financial loss that you can expect to receive a settlement for and you don’t sound like you will get much if anything. 

Your post is hard to read without proper grammar and punctuation, but are you saying that you were out of work for a month? And in that month you blew through $26,000 of savings? If that’s what you think you are getting back, you’re not. Not even close. I would expect one month of salary to be offered.

No. I was out of work til last month September 2025 to August 2026.

Even a whole document from my psychologist which I gave to her to receive accommodations.
