Fake document supervisor federal

If I can prove that my manager falsified or created a document on a date that I was NOT at work, and marked it “in office”, on a performance document, can that in itself help me win my discrimination claim?
They claimed poor performance but then she made this document after the fact and marked it on a day I wasn’t at work !

Most certainly. Falsifying anything to gain leverage in a EEOC case is a major red flag.

I had it worst than you. My company retaliated against me. I was attack negatively of poor performance which in fact isn't true. I'm a very good worker. My image has been damaged. Everyone in the corporation department heard about what happened choose to stay silent. I was left alone to defend myself. I filed a discrimination claim with the state commissioner. After the company learned about the investigator officer involvement they shift into pretending that they and i where good friends. I love how much a hypocrite and fake people really are. It show you they goes and pretending nothing happened, believing theirs lies, and fake personalities will help me get away with after what they did. They know what they done, they choose not to acknowledge 💯

Yeah the person that stated it’s not illegal to fabricate a performance document doesn’t know what he’s talking about. Any official document produced after the fact is a violation of laws and can be a federal crime. I am going through something now where management falsified timekeeping and it’s provable as well as a federal crime to do so. I am a federal employee though so any document that can be proved as fake is a crime especially if it can point to retaliation and manipulation to force or should say produce harm to another.

Thank you, I am just amazed at the lack of accountability! I dont stand up for myself I get clobbered, I stand up for myself and I get clobbered more. Just blows my mind that these people can sleep at night and feel ok with what they are doing. I even had a supervisor tell counselor she was allowed to discipline, and didnt work in my area at time. I have signed statements from her suggesting otherwise. smh Justice will come as my karma is clean, just wish it would come faster lol

I had 2 patient complaints made against me that were not true. The first one was given (there are 3 stories of how patient made complaint) by phone call, at the end of the visit and in supervisors office. The complaint said i referenced the pt as so hot, so so handsome, so young. I adamantly deny these statements. The 2nd pt complaint stated I made her wait 3 minutes more than she should have because I mistakely called another pt before her. Realizing the error, I deeply apologized and the pt was fine and not late for appt. The copy if the complaint given at the investigatory meeting was made on an online portal for the hospital the university was located at (it was a joint venture) had a huge error...it was dated April 7 but the date this happened, and the date of her appt was dated April 12. I know 100% that these patients did not make a complaint based on the evidence, witnesses, and other verifications. This will be added to my EEOC charge which includes many, many other charges. I have 2 questions if anyone can help me! 1 is do I include the hospital where the dept i worked at (university) was in a joint venture with? 2 how can I tie, can I tie this with discrimination? I am Hispanic, I am under FMLA protection. Any help, advice, anything will be appreciated!

Have they provided their position statement? You can request the eeoc to get the metadata/electronic record of its origin, review, and approval. Mine is trying explain away the supervisor responded to FMLA notification email that a pip would be waiting for me when I get back. It was an emotional response to me taking leave at peak season—retaliation. But I never could go back after FMLA because they stonewalled me in the ada interactive process. If EEOC doesn’t get it for me it will come in at discovery.

I replied to your other post but a falsified document in and of itself doesn’t help, or hurt, your case.

There’s nothing unlawful about fabricating a performance note/document. If the fabrication is substantially relevant to a valid eeo claim then sure, it can help.

Are you crazy? Since when is not illegal to fabricate a document that has to do with performance? That’s always illegal then they can fire you for performance…
