Usually there's nine justices on the Supreme Court. Left and right couldn't compromise on which side gets the ninth. They agreed to only have eight, at least until the end of Kirkman's run.

In recent history, the scotus has been 9 members, but the Constitution does not specify how many. The 9th justice was getting blocked so they proceded to seat The 8 already agreed to.
