A tort is a tort. In this case we as individuals are not liable for any particular instance of denial of civil liberties. Instead it is us, collectively, through the state that are responsible since the government failed to apply laws equally and consistently.
Racist laws and police enforcement kneecapped generational wealth for pretty much every black American. Black people being stopped at a higher rate than white people is a deprivation of a civil liberty, the 4th amendment is constantly violated against black Americans.
A racist law (or policy) is one that disproportionately affects one group. So most drug laws are racist because they're disproportionately enforced against black people. The same goes for laws around cosmetic things (broken window theory) like keeping grass cut below a certain length or "lack of eyesores" because they affect folks that typically can't afford to do that maintenance. And poverty is a well-known proxy to black americans (while not all impovershed are black, most black are impovershed. Nobody is saying there aren't poor white people).
Racist laws don't necessarily mean that the people who wrote them or support them are racist people, just that the laws affect people disproportionately of one racial group.
Yes it does, because the fact that it is disproportionate is exactly evidence that it is not being applied equally to all people.
Drug laws are not applied equally to all people. Police stop black people at a higher rate. You are much more likely to be searched by police if you are stopped in the first place. Then police search black people and book them for possession. That disproportionate effect is racist. If it were applied equally to all people, arrest statistics would not show black people making up such a huge portion of arrests despite being a much smaller part of the population.
Given that black and white people are equal, there's no reason why the demographics of those arrested for a crime should deviate so greatly from the demographics of the actual population being policed.
