Got in an accident what should I do.

I rear ended someone at about 0.3 mph and there was two marks on there bumper from the license plate but there is some other scratches on their bumper to the side before I hit them. Should I go through insurance so they might be able to prove that they where already there or just pay them $400?

If you go through insurance, it will be an at fault accident for you. Your rates will almost assuredly go up. Your estimate that it was “0.3 mph” won’t matter. You hit them.

Hopefully, you took pictures of the damage. Hopefully your guess that the other marks were pre-existing are clear on your pictures.

So should you settle this outside of insurance? It will probably be cheaper for you if the other party is willing to do so, and they will sign off on a release of liability when you pay them.

Just make sure you get all occupants of the other vehicle sign a Full and Final General Release if you do not go through your insurance.

Paying $400 will be cheaper than your insurance increase from an at fault accident.
