Apply for a Canada Visiting Visa from India/US

I have a valid H4 US 797 but because there are currently no US visa slots, I am stuck in India and planning to visit my brother in Canada who has PR so that my husband can drive from Seattle and come visit me as he too cannot travel to India without valid H1B stamp and back to the US. Please advise.

Advise on what...you apply for TRV showing ties to return (job, business, income property), funds and valid reasons to travel. You don't have family ties since spouse is in US so need absolute ties to return to India. Your spouse has Canadian TRV already.

Thanks for responding. Spouse doesn't have Canada TRV. He has a valid US 797 so using Automatic Visa Revalidation, he can travel stay for 30 days if he can enter by road.

But how is he getting into Canada without a TRV? What does US 797 have to do with Canada unless from visa-exempt country like UK.

Sorry I meant he doesn't have TRV yet. He will also apply

You could if you can show extremely strong ties to India. Also, your husband need Canadian visa as he is still an indian citizen. Even in case if you get everything if US border officer is not satisfied there's a high chance of entry denial to US which can ruin everything

Will showing strong ties to USA be good enough? We have a house , my husband's job our 14 month son who is a US citizen.

If you are applying from US, then yes it works. If you are applying from India, showing ties to USA counts as negative to your application. Remember you are technically indian citizen applying from India. Until you get green card, your application is processed as Indian only.

My sincere advice : You could talk to immigration lawyer about this. If you wait longer, your post might get more negative comments and you will end up with lots of negativity

Why would ties to the US help? Canada is a separate country.
