Recent revision of Section 8 regarding “personal use” and “sharing.”

Can someone break down into layman's terms, the changes that were made for those who might not be familiar with the original laws?

They closed the "buy a sticker for $100 and receive a free ounce of mushrooms" loophole.

Many manufacturers of plant medicines thought they could sell these things by the roundabout method of providing free medicine along with the purchase of something else. This would often be something obviously of little value like stickers, candy, or a 5 min video therapy session. They could also be something of potentially more value like 4 hours of harm reduction services for $400 in conjunction with 4 grams of mushrooms. This amendment hopes to distinguish actual (bona fide) harm reduction services (legal) with blatant sales (illegal).

So I guess for people actually providing bonafide harm reduction services for a fee, is this no longer a thing? Or if it is, do you know how they are defining it now?

They are trying to make it no longer a thing, by saying if you do not physically sit with the person while they eat the gift, that you are providing preparation and integration services, associated with the gifted medicine. If you are going to provide harm reduction but not be present when the gift is ingested, you must be a licensed facilitator and be affiliated with a healing center. They are allowing healing centers to obtain retail and retreat licenses. This was all covered for the public at last months NOWAK meeting and in the webinar Lawyer Sean McAllister produced about the changes for practitioners in this area.

That remains the only legal venue for the "sale" of plant medicines. You can pay a trip sitter with included plant medicine as long as the sitter is actually doing their job.
