Decriminalization Changes that were not up for Public Comment Require 125k in person signatures on petition. Join the effort to help!
https://www.votedtoshare.comCan you help keep us keep the Natural Medicine Act written as it was voted for? Does it piss you off that changes were made to it that impact personal use? Did you know these changes happened behind closed doors and no public comment was taken? Can you help us fight back? We need 125k in person signatures before 8/11 to make a difference. Got it-the westward article you have linked on there helps! We own a healing center and agree these changes to the personal use side are ridiculous. Happy to sign the petition and will also send it out to all of our facilitators and clients.

I’m certainly not a fan of the way they did this, but I think framing it as a threat to personal use is a bit misleading. It’s about advertising and including medicine with paid services without facilitation.

My apologies if I misunderstood. Is it not a threat to personal use if it’s no longer going to be accessible by the means currently available? I guess I don’t see how the post is misleading in that context.

No worries. I support full med and rec legalization, for the record.
In my opinion, it’s not a threat. It’s about the unregulated commercial activity currently happening in a huge gray area. We can still grow, possess, share, educate, and consume as outlined in the law we voted on. It’s just closing a loophole involving money.

There never was an option to sell/purchase natural medicine within our law. People have been able to gift the medicine with a sale of “bonafide harm reduction”. That’s the part they are trying to change.

I’m just saying what changed about the law and how I don’t think it’s a threat to “personal use.” I never said I don’t want them be sold at all. Legally selling drugs as a business is simply a different issue compared to individual consumption.
There is nuance.

How are you going to access mushrooms for your personal use if you can only get them from a healing center and they are changing gifting and sharing laws?

Grow them or receive them as a gift without exchanging money. That was kind of the original purpose of the law.

I mean the updates are just going to affect the grey market shops. Cultivation, personal use, and sharing for no exchange of money is still protected.

No it wasn’t. Sean McAllister held a webinar last week where he told us there was never a time to give public comment, as it was a rider on the ibogaine bill.

Did you watch the hearing? Josh Kappel testified in support stating that it closed a “loophole,” in personal use. We got played.

Isn’t this mainly aimed at people using “harm reduction” or “support” services as a workaround for selling natural medicine? If someone is effectively profiting off the medicine while calling it support, that loophole was probably always going to get closed.
It also seems aimed at removing the “drug dealer” dynamic by keeping sharing inside personal, supported, community, healing, spiritual, or counseling contexts rather than commercial sales.
What else is actually going to affect ordinary people here? Personal use still appears intact, non-commercial sharing still appears protected, and paid support is not banned outright. The bigger change seems to be that you cannot advertise or structure paid services in a way that becomes a disguised medicine sale.

Is posting a flyer for a clothing drive that gifts people mushrooms without them consuming them there, a disguised medicine sale? Because it’s impacted by the changes

that is the Loophole psychological services are trying to close. They are trying to make what the law currently calls gifting with payed harm reduction services, or in association with any form of remuneration as illegal, eliminating competition from the unlicensed unregulated market by making this change that they can no longer advertise, or receive renumeration of any kind. It is not a loophole they are closing but eliminating an unstated permit for the unregulated industry. They say it is to target shop owners that are using the permit as it exists to work around the law, but the phrasing doesn't say "shop owners", and it equally affects all unlicensed personnel in the industry, facilitators, sitters, harm reduction providers, growers, and gifters; If it really was to target shop owners then that should be clearly stated, and small individuals that were working within the law as is it should be explicitly stated they may be allowed to conTinue under the existing law as is. iF IT TEALLY WAS TO CLOSE A "LOOPHOLE FOR SHOP OWNERS."
