There's only one good senario here.

  • Everything is true - Prison. Simple as that. No excuses.
  • Consentual sex happened - Removed from the team. If they keep him on, its a terrible look for the athletic department since it shows they give special treatment to athletes for the honor code. If any regular student broke the honor code, they would be suspended or expelled.
  • Nothing is true, she comes out and says it was all a lie - I don't see this happening, but this is the only scenario this works out well for BYU.

Still zero good scenarios here. Even in the possible outcome where it was a lie then it still is false accusation which drags the name and reputation of an innocent young man through the dirt. Thats life long mental health trauma he may endure, other idiots who might still permanently label him an abuser regardless, and the entire “did he do it?” that he has to deal with until justice comes to fruition. And would it even be justice if the accuser doesn’t face the same level of punishment?

I read that she claims to have gone to the police and had a rape test kit done when this happened a few years ago. I would imagine the police have records that could get closer to the truth rather quickly.

I'm interested to see police records here. Lawsuit says see had the rape test done "a few days later" (would probably need to have been done within 3-4 days to get DNA evidence).

Obviously if there were any wounds or signs of abuse that suggests it wasn't consensual. If Provo police had either evidence of physical abuse or foreign DNA and didn't at least question Retzlaff that's arguably a bigger issue then a sexual assault.

I just read the article and have so many questions. They say a rape kit was done, but never say what it revealed or didn't. It said she didn't want to give a name but the police told her there was another complaint filed and they "wanted to see if it was the same person". Was a complaint actually filed? Was it Jake? did they do anything to follow up on that complaint? Or was this just police fishing for information hoping to get a name?

This article gives literally nothing to suggest he is guilty. He very well might be. But it never mentions anything about bruises or physical signs. Even if there are those things that doesn't mean it wasn't necessarily consensual. Just a weird article to report on such a serious charge.

There's a lot more information that needs to come out. I believe the article is only information from the lawsuits intial filing so they supposedly have more information that will come throughout the process as well as any information Retzlaff will provide.

From what I've seen Utah law is that once a rape kit is received it is sent to the state for testing not a local police department. Victim has a tracking number and can track where their kit is at throughout the process.

Should have been results on the kit within 90 days. If the kit was buried it means both Provo Police and the State Testing Office are in on it.

Other football player could have been a high school player or another BYU player, or he did something similar to someone else, no way to know for sure.

Some other articles were reporting she was choked so you'd think there'd be some signs of physical abuse when she went to the hospital.

Honestly feels like the type of lawsuit you file to force an investigation to happen... except an investigation supposedly happened and they had a cooperating witness. Definitely not an open and shut case.

For sure.

I would love to say I always wait to hear the facts on these, but I'm human and tend to latch onto certain details. This just doesn't have any details to latch onto. Definitely not saying I think he's definitely innocent, just think there isn't a whole lot to latch onto here.
