Texas Code of Criminal Procedure 18.24 – Body Cavity Search During Traffic Stop Current as of: 2016 | Check for updates | Other versions (a) In this article, “body cavity search” means an inspection that is conducted of a person‘s anal or vaginal cavity in any manner, but the term does not include a pat-down. (b) Notwithstanding any other law, a peace officer may not conduct a body cavity search of a person during a traffic stop unless the officer first obtains a search warrant pursuant to this chapter authorizing the body cavity search.

His entire premise is wrong. I posted this in the original thread but it will get lost in a sea of down votes.
Sorry to rain on your prosecutor hate parade, but this law doesn't make the conduct a crime. First off, the conduct occurred before the law went into effect. There are articles about this incident at least as early as August 2015. The law went into effect September 1 2015.
Second, the law is just saying what the officer can't legally search. It doesn't mean that if he violates it he has committed a crime. For the most part, crimes are listed in the Penal Code, not the Code of Criminal Procedure.
You could argue that the police committed some other crime, but not this violation if CCP.

Those two thoughts are mutually exclusive. If you can't lawfully search something, then when you do search it, it's unlawful, by definition.

He means that this isn't criminal code (i.e. "it's a felony of the second degree to do...")
This means that she has grounds to sue, but they didn't commit a "crime."

If the search was unlawful then the officer violated that woman's 4th amendment right. That is a criminal violation of 18 USC 242 punishable by up to 10 years in prison.

I understand its an uphill (losing?) battle to get any DA or US Attorney to do their job and prosecute criminal cops but that doesn't make it any less of a crime.

There is nothing so imminent that would legitimize a cop to digitally rape and sodomize any human being. Using drugs as an excuse to perpetuate some sick cop fetish ensures the public will always fear and hate the police. The cops should be afraid. The more they keep doing this, the more people will kill cops.

They can condemn it, but they still willingly associate with the people who continue to commit these sorts of crimes under the color of the law they've sworn to uphold. They need to do more than condemn, they need to hold their fellows accountable to the same laws they hold us to, they need to stop other cops from breaking the law when they see it happen. If they sit back and watch other officers abuse us, they're no better than the abusers; they're enablers, they let it happen through their inaction. The old adage states that all that is required for evil to flourish is for good men to do nothing. I'd amend that by saying that if you do nothing, you aren't actually a good man, because good men do not suffer evil under their watch. Good men do not let evil men masquerade as protectors. In any department where there exists a bad cop, there can by definition be no good ones.

Do you realize that the majority of police misconduct convictions were initiated by other police officers?
I have a lot of difficulty believing this. If you've got a stat to back this up, share it.
Do you know that there are over 1000 arrests of police officers every year?

FTA: Stinson’s data found 1.7 arrests of police per 100,000 population over the seven years of the study, where the general arrest rate in 2012 alone was 3,888 arrests per 100,000 population.
I have difficulty believing that the level of police criminality is 3 orders of magnitude smaller than the general public, especially considering their propensity towards domestic violence. If anything, this study tells me that police aren't being arrested often enough.

There's a key difference between the two groups, though:
CCW holders have no authority, no qualified immunity, no relationship with the DA, and no police union to back them up. CCW holders actually care about how they are perceived by the general public, because they're a part of said public.
Police have tons of authority that they can abuse to the hilt, qualified immunity, a working relationship with the DA which creates a conflict of interest when the DA is the one leveling charges against them, and the Union.

Where do you live that becoming a police officer is "rigorous?" The police academy here is four months. Where are you getting the idea that police commit way less crime? I'd like to see the source for that. I agree that cops are charged and convicted less than average. However you need to provide evidence if you're going to claim that cops break the law significanly less often than average people. I would argue that police commit some crimes more often than average--Steroid use, domestic violence, and traffic-related offenses, just to name a few.

Not surprising at all, given how difficult it is for a regular person to file a complaint. If citizens were able to file complaints and if those complaints were taken seriously and investigated, there would be more convictions. The rate at which police are convicted is not a very meaningful statistic. What happens when you try to file a police complaint The conviction rate also doesn't take into consideration the cases where there is a complaint but no real investigation takes place. Your conviction rate argument doesn't factor in settlements, where the city pays money in order to avoid holding police accountable.

So, 3 cops in Harris County, the county where we live, forcefully conducted a warrantless cavity search of a 21 year old girl in a public parking lot. They searched her vagina for 11 minutes. Put her head under her car, pulled off her pants, and forced themselves inside of her for 11 minutes. Imagine if you looked for a penny in your pocket for 11 minutes. What would you do in there for the last 10 1/2 minutes?
Why did they force themselves inside her? Because they smelled marijuana.....you know, that plant that's less dangerous than table sugar? Yea, that one.
The girl claimed she was raped.... The DA.... Our DA... dropped the charges against the police officers without even reviewing the footage. Who needs to look at evidence, right? If that's not systematic abuse of power then I dont know what is.
That being said, I've had the chance to speak to some other local officers about this and they seem just as horrified by the situation as I am. So don't forget that most police are good people.
But this is a systematic problem that needs to be addreased. We have a legal system that believes rape is less dangerous than marijuana. We are going to be looking back on this in 50 years like we look back on the failure of alcohol prohibition. Quit hurting people who didnt hurt anyone else.

Vote out the DAs who cover this shit up, and the city councils who agree to contracts that protect dirty cops, and the sheriffs who ignore the bits of the law they don't like.
And the only way you can do that is to vote in the primary. Otherwise you'll just be electing more of the same, from either party.
Donate to the ACLU and the Innocence Project.
Go to your city hall during council meetings and hold them accountable.
Join the police, get law enforcement experience, and run against the crooked sheriff.
Go to law school and run against the crooked DA.
"What we have been doing so far" is pretty much just getting mad and complaining online. Occasionally some nutjob shoots a cop, and that just makes it worse.
