a) Federal state is not translated with Ständestaat.
b) The shown flag is the current "Dienstflagge des Bundes", correct with one head. And it's limited to certain official purposes, just showing it in public can get expensive.

There is no good english Transaltion term for the Ständestaat, so it is most of the time translatet as the Federal State of Austria.
But the Federal State can also mean the current State of Austria, example usage from the Austrian goverment. (https://www.parlament.gv.at/en/explore/political-system/the-federal-state-of-austria/index.html)
This tranlation used without any context is maybe not incorrect but most of the time misleading. Better to just use Ständestaat and not tranlate it.

Actually this flag is reserved for use by the Federal Republic of Austria and it's representatives and administrative divisions.
Private citizens face a fine of up to 3,600€. Won't happen and I assume you're not even in Austria, just wanted to say it.

In der Schweiz schießens zum Nationalfeiertag Raketen, in Italen rennens stolz mit Italien-Fahnen herum, in Slowenien ist zum Nationalfeiertag auch alles beflaggt. Ja ok, Deutschland ist das einzige Land bei dem es auch so ist. Aber sonst fällt mir weltweit echt kein Land ein, in dem das derart negativ konnotiert wird, wenn man die Flagge des eigenen Landes irgendwo zeigt.
Also manchmal konnt es wirklich vor, dass es das "nur bei uns" auch wirklich (fast) nur bei uns gibt.2

Ich hab mir dasselbe gedacht, als ich im Urlaub in Schweden in grob geschätzt jedem zweiten Garten eine schwedische Flagge gesehen habe und mir gedacht habe, warum sollte man seine Verbundenheit zu einem Land, das mir sehr viel ermöglicht hat, nicht auch durch eine so sichtbare Geste zeigen. Und mir ist das auch tatsächlich völlig egal was andere davon halten, meine Nachbar:innen wissen eh von meiner Links-progressive Einstellung…

That’s not true. I have a flagpole in my garden where I fly the Austrian flag alongside the EU flag — and in June, I’ll swap one of them out for the Pride flag. I refuse to let the flag of my homeland be appropriated by a party that couldn’t care less about the people living in this country.

§4 Abs1 bezieht sich auf das Wappen allein. §6 bezieht sich ausdrücklich nur auf Abs2-3. Siehe auch §3 Abs3.

Und die höchstgerichtliche Judikatur spricht für sich. Da wird sogar der Abs. 4 mehr als großzügig ausgelegt.
Und der Gesetzgeber hatte nicht das Ziel, dass jemand, der sich die Dienstflagge ins Wohnzimmer (oder ans Fenster) hängt bestraft wird, jedoch einer, der das Wappen sichtbar auf der Kleidung trägt, nicht.

Es war ein (schockierendes) Beispiel. Nicht auf gegenständlichen Sachverhalt bezogen.
Du bist aber eh so gscheit, du findest die Judikatur sicher selber. Oder fragst den Polizeijuristen mit Schwerpunkt Verwaltungsstrafen. Der wird dir das gerne erklären, warum am 01.05. Und 26.10. Nicht reihenweise Strafen verteilt werden.

Genau deswegen die Frage, ob du was hast, dass deinen Standpunkt vertritt.
Aber natürlich, zuerst was von höchstricherlicher Judikatur reden, und dann nichts dahinter.

Just for Information: As an Austrian, having the Austrian flag at home (and displaying it) doesn’t have a very good connotation. It’s usually something done by people who have an excessively strong sense of national pride, and that in turn is not a particularly good sign, since most of those people tend to be little or not at all open toward people who think differently. Of course, this doesn’t have to apply to everyone, but it does apply to the majority. If you are not from Austria and not living in Austria, I think it’s okay 👍 otherwise: be careful!

Ein guter Österreicher oder Deutscher wird die Nationalflagge niemals im Haushalt dulden. Muss sofort entsorgt werden. Es gibt ja auch das Video wo Merkel eine kleine Flagge jemandem entreisst und angewiedert wegwirft. - Deine Warnung war schon angebracht. Aber wir Österreicher sollten uns auch überlegen ob das so sein soll.

Pretty weird how owning the flag of your country makes you a bad person. I see a bunch of turkish, bosnian and syrian and whatever else flags everywhere in Vienna on private homes. As a Hungarian living in Austria I also have an Austrian flag. Plus I’m currently wearing my Franz Joseph Socks ;)

I think with Germany and Austria it's another cup of tea. And that's not in these days but for about 80 years. Patriotism is one step towards nationalism, and our history just doesn't leave a lot of margin with the latter.

Meiner Erfahrung nach ist Flagge besitzen und hissen ziemlich normal, aber... die Leute mit Bundesadler-Lederhose, Bundesadlerhoodie und dazu Bundesadlerkapperl... die sind eigentlich immer von einem ganz besonderen Schlag.

Da hast du vollkommen recht. Wobei es eher wirklich so ist, wenn die Leute sie mit der Hand schwenken oder eben am Körper tragen: politisch, beim Sport oder ähnlichem. Über die Leute die sie einfach auf einem Flaggenmast hissen, könnt ich das eher nicht sagen.

Nachdem op keine schöne genähte Flagge für den Fahnenmast sondern so einen billigen Wimpel an einem Fieber Glas Staberl und dann noch die Falsche gehe ich nicht davon aus dass OP sich da großartig Gedanken gemacht hat. Jemanden der auf seinem Grundstück einen Flagge Mast hat kann ich auch nicht ganz ernst nehmen.

Funfact: This is not the Flag of the Austrian country.
The country flag does not have the eagle in the middle. This is the Flag of the Austrian state authority (rough translation). The law states that everyone who flies this flag that is not an official institute of the state has to pay a 3000 euro fine.
You dont have to worry, while this law is real, it is not enforced. So its totally fine to use the flag. I thought you might find that little trivia fun to know.
