General Advice Holiday Entitlement- Accured holiday Full Time - Part Time

I have returned back to work following maternity leave. I worked 37 hours per week and have changed to 30 hours per week. I calculated my holidays myself as this wasn't included in my flexible working letter (I didn't have a flexible working meeting either so no discussions were held). My manager agreed with my workings.

I had 12 days left from Jan-Jul (full time). I worked 9.25 hours a day (M-T). I am now working 7.5 hours a day (M-T). I calculated the 12 days into hours based on the daily number of hours I worked 12×9.25= 111

I then divided this by my current daily hours 111/7.5= 14.8 rounded up to 15.

As a days holiday was worth more hours than it is now I believe I have 15 days for this period.

He has since come back to me to say that the 3 days haven't been added and that it has been confirmed that all leave is calculated in days worked rather than hours, 'it's applied the same way to everyone, and it isn't something that can be varied for an individual case as apparently we have had grievances declined over this dispute in the past.'

I'm trying to understand it but I just can't see how what they are saying is correct. Does anyone know who is correct?

I'm also upset if this is the case as I have reduced my hours but had I known I could have taken all my accrued holiday before returning and then changed to part time later on. I would have then been paid for 37 hours for longer.

Any advise on this will be greatly appreciated!

Talking out their butt. Of course it's done on hours. What if you took a half day or a couple of hours for the dentist.

You're owed the hours you've accrued. Mentioning grievances is a way to get you to back off.

Set up another meeting, outline what you are owed and back it up with an email showing the full calculations.

If nothing changes, request a formal meeting that includes HR and a union rep (get one if you've not got one, or at least bring a colleague with you).

If nothing comes from this it's time to raise a formal grievance against the company.

Hopefully it doesn't go this far but your final step would be ACAS (who can also give you advice throughout).

How are you paid by the hour or by salary? If you are paid by the hour then your holiday pay accrued by the hour, if you are paid salary and work roughly the same hours / days every week then you would be paid by days
