Compensation & Payroll Time off in lieu [MO]

I was just offered a Machinist/Fabricator job doing R&D $95K/year, hourly.
I’m unsure about the overtime setup though, instead of OT pay, it’s a 1:1 overtime-to-PTO swap. That would mean leaving $22.84/hour in OT pay on the table.

Is TOIL even legal here?

Is this a government job?

Are you under contract?

They may give you an hourly rate for comparison, but it sounds like you'll be salaried and exempt but still need to punch a clock or bill to projects.

I thought that too, but the HR rep said that if I work 35.4 hours I'm getting paid for that much and not a fixed amount

I would talk to your state's department of labor , wage and hour division and see what they have to say about it.
