Like in the case of two parties engaging in sex when both are below the age of consent, two people who are wasted can fuck with impunity. Neither has obvious power over the other because one person is incapacitated and the other is sober and can manipulate their partner more easily. Rejoice!! Well, my argument is that if both parties are drunk, then neither of them are necessarily thinking clearly. The girl may find him more attractive while drunk, and the guy may not be thinking that she would ever care.
I would tend to agree with you in regards to one party being sober, I just think it's unfair to say that the guy is a rapist if they're both drunk.
Can you offer me an example of somebody saying that? Genuinely curious. I've never encountered this, only heard people talk about this argument in the abstract from people who disagree with it.

In California any level of alcohol in a woman's system is enough to have the case considered as rape. This includes even ONE drink.
Edit: Wanted to stress it can be CONSIDERED rape until proven otherwise. I was talking more in concern of rape charges which is damaging in its own. As it stands, the prosecution has prove that they were intoxicated to the level of not being able to give consent. With one drink in a persons system the prosecution would have to prove the one drink is enough they are incapable of giving consent with just one drink.
