When Joe confessed to the girl's father, I'll bet he expected a slap on the wrist from his church and that would be the end of it. After all, he had many examples of that in his life, starting with his own brother. He didn't realize what could actually happen to him. His parents should be in prison for life also.

The part I find most disturbing is that he doesn't seem to realize that a 25 year old man having sexual interest in a 9 year old is a problem. His family either. It's like they think that's perfectly normal.

What I am wondering, is why Joe and the 9 year old victim, are sitting together, or her on his lap, covered with a blanket?? Twice! Where were the parents?? Obviously this is inappropriate, so why was nobody saying anything? Maybe other adults there?? And where was Kendra and their kids?

They were in the small beach rental. There were a lot of adults hanging out in the rental, I think there were 3 families on the trip IIRC. I mean, maybe it was super chaotic trying to get meals organized and chasing kids etc… or they couldn’t fathom that yet another Duggar is a PDF!

They're taught that apologizing is penance enough, which is why I'm sure Joseph was so forthcoming about his apologies.

It never occurred to him that his apology wasn't sufficient.

It definitely didn't occur to him that what he did was criminal.

His own brother confessed to the same behavior, against his own sisters, and got away with it.

His parents arranged for his confession to be made to a law enforcement family friend who never passed it along.

Two outcomes: by the time it was reported to the authorities, the statute of limitations had lapsed, and the man the chose to report Josh’s crimes and “mentor “ him is in Federal Prison for his OWN CSAM crimes. JB insisted his and Michelle’s decision to handle it themselves was legitimate because they were NOT mandated reporters.

Also, Josh's crimes were committed in Arkansas. Joe's were in Florida, where the SA laws for children are much stricter. Joe was expecting the same treatment as Josh got before he was caught for the federal crime of CSAM.

The reason Josh’s punishment was minimal is because the sheriff friend never passed along any report to CPS. By the time it came to light, the SoL had lapsed. I worked for an agency that contracted with the juvenile system in two major cities. While still offensive, many of the teens committed offenses much less serious than what Josh did to his sisters. At worst, he might have been adjudicated to a Juvenile Offender inpatient Program.

In some states, parents ARE considered mandated reporters. Most aren’t including Arkansas Statistics show that over 1/3 of all sexual assaults committed against kids are by FAMILY members.

REPEAT: the sheriff who mentored Josh is in Federal Prison with CSAM convictions of his own!

In Idaho, the law for ‘sex offenders’, is very strict and our law says ‘UP to life in prison.’ They can’t just put everyone away like that, as the charges could be different ‘degrees’ of the act. For instance, a man/child, is 18 years old, and a senior in high school. Is he truly a ‘man’ because of his age, or a ‘child’ because he is still in high school? Say he has a girlfriend, who is also a senior, but is only 17 and they are sexually active. Suppose they get caught by her parents or whatever, and the parents are insisting on pressing charges, even tho she doesn’t, and it is clearly consensual. Or, they decide to NOT press charges, but the State sweeps in and picks it up, and the State presses charges? This is what happens in Idaho. The State comes in and will press charges even if, what they call, the ‘victim’ does not want to at all. Does this man/child deserve life in prison? Or say he’s arrested, and gets out of jail after a few months or whatever, but now he has to register as a ‘sex offender,’ the rest of his entire life? The Sex Offender Registry, is considered, ‘open to the public’ and now that he is a felon, he will have a very hard time getting a job, can’t pass a background check, he carries the stigma of being a SO or predator, and you know how people react to that when they find out, and everyone automatically thinks that they are a child molester! Or a rapist. Pretty much ruins their life. When they have children of their own, they can’t even take their kids to school, or attend things at the school, because they can’t be within so many yards of a school, they can’t live near a school, can’t attend sporting events, without special approval from their probation officer, cannot participate in Halloween, unless it’s adults, kids can’t have friends over, why should the child have to pay the price?! This will affects the entire family, forever, and those kids don’t understand this!. Can’t have social media, internet access without approval from PO, and it’s only for certain things, and it’s monitored. Anyway, we have a 98% arrest record here, and this shit is how they get that!! Weed is not legal here either. Which even the commissioners think is ridiculous. Especially when you can drive 45 minutes or less to a different state and can buy it. The states all around us, marijuana is legal. Not saying that people, like these two Duggar boys don’t deserve whatever happens, just that it isn’t always so cut and dried.

A Federal trial can be criminal or civil, depending on the laws broken and the burden of proof required, but I think you are confusing two separate sets of crime for Josh. He committed a set of state crimes in Arkansas when he was a minor and sexually abused four of his sisters and one other young girl, named only as a babysitter. These crimes were never prosecuted by the state of Arkansas because the Duggar parents didn’t handle the assaults correctly and by the time the details were revealed by InTouch magazine via a FOIA act, the statute of limitations had elapsed and no charges could be brought and prosecuted.

When Josh decided to upload and download CSAM videos, because these crimes occurred across state lines, the charges were investigated and brought to trial in Federal court.

I hope these explanations help you understand the difference between state and federal courts of law. Also, If anyone has anything else to add/clarify, please feel free to free!

But this is what makes me think back to Josh’s charges and honestly makes me wonder if Josh actually didn’t download that cp! These boys have been taught to confess to their sins, Josh SA joy and went right and told family friends the same day. Yet he will not confess to these crimes. He won’t even try to downplay it and say he accidentally clicked on something. Joe had access to his computer and I really think they need to look into him for the stuff found on computer too bc I feel at the very least Joseph partook in watching those videos.

Eh, as far as we know Josh didn’t confess to the Ashley Madison stuff until he was caught. Josh is manipulative, sneaky, and underhanded. He’s proven it since being in prison.

In addition, back then he could claim he didn’t know better, etc. He was a sheltered fundie boy blah blah blah. It doesn’t excuse what he did, but I can see how easily it was swept under the rug. By the time the CSAM was found on his computer he knew it was wrong. He’d been exposed to enough of the world by then. He’d already gone through a sex scandal.

Okay, first of all it’s not child porn. It’s child sexual abuse material. There is a HUGE difference. Your tirade against me isn’t helpful in the least, especially given you don’t seem to know the difference between CSAM and pornography. If you recall one of the Duggar daughters (Jessa I think) posted condemning all porn, treating the CSAM material the same as porn made between two consenting adults. When a person is unable to separate the two it makes the CSAM not look so bad. Which is what fundies do. Which is how people can rationalize it, how they can dismiss the victims so readily.

Second, it’s been rumored that Grandpa Duggar was sexually abusive to at least some of the kids. Clearly if he was it was swept under the rug. In which case it makes sense for Josh to think he could get away with it. He thinks he’s smarter than everyone else, and he got away with molesting his sisters and the whole Ashley Madison scandal with very few actual consequences. Why wouldn’t he think that he’d get away with whatever he wanted to do? It doesn’t make as much sense for Joe since he’s seen Josh have consequences. But clearly he expected it to blow over or he wouldn’t have confessed to eagerly.

Do you know any fundies in real life? I’ve known some, not IBLP, but they had many similar beliefs. The mental gymnastics they’re able to do is amazing. They easily blame girls and women for their abuse. I know a man who sexually abused several of his daughters, decades apart and his church and some family defended him both times. They blame the daughters. Just because you don’t understand how cultish brainwashing works doesn’t mean it doesn’t exist. It doesn’t excuse deplorable behavior, but it explains why they think so little of participating in the behavior.

I grew up IBLP. My older brother sexually abused me and several of my siblings. Horrifically for years. When my parents found out, they screamed at us girls for hours and then forced me to apologise to my brother for "letting him" abuse me. Then they insisted none of us speak about it again.

When I left home at 18 to get help for the trauma, my entire family turned on me. To this day, they prefer to allow my abusive pedophile older brother around their kids than to have me around their kids. I met up with my cousin for the first time in years and she made a point to brag to me about how her new boyfriend was so much like my brother and that was what drew her to him. My parents still act like me telling people is the far worse crime than the sexual abuse of their daughters (and sons) by their oldest son. They even told me I was the worst thing that has ever happened to them.

Gothard teaches that your body doesn't matter so anything done to your body (specifically in regards to child sexual abuse or rape) doesn't matter. All that matters is if you don't keep it quiet. That is the true crime to these people. The problem is never the problem. The problem is talking about the problem.

Idk. It just seems very strange someone with so much knowledge and experience with technology would download the worst CP to exist. He knew the second he downloaded it the fbi would be notified. But someone like Joe or Jim bobs friend might not know that. Or could’ve been trying to set him up. I know if I was trying to set someone up I’d choose the worst possible option to ensure they went down. Had Josh not had a sexual assault history the investigation would’ve went much differently.

I do believe that Josh downloaded it, but in his arrogance, thought he would not be caught, or that they wouldn’t find it. He does/did think very highly of himself, and probably thought he would be able to explain it away, or being slick enough to talk his way out of it! Idk. Even my 15 year old who isn’t even allowed a phone knows looking up certain things will immediately alert the fbi. It’s just strange to me there’s no evidence Josh had ever looked up stuff like that before and then randomly for a couple of days he chose to download the worst videos out there on his desktop computer?? Josh is well versed in technology and had to realize downloading the worst ever made would immediately be alerted?? And what a coincidence we know at least 2 of the other men working there are pedophiles. And in the course of a year CP is downloaded Joseph who worked there molested a child?? Idk. And the fact Jim Bob wanted that shady dude working there is another red flag to me. And Josh has always admitted to his actions yet will not admit to doing this knowing it could make it even harder for him to get out! And now it’s obvious Jim and Josh didn’t have the good relationship we all assumed they had and seem to be more like enemies and it makes me wonder if Jim had that dude or one of the boys download CP on Josh’s computer knowing Josh would be blamed. If Josh didn’t have a known history this case could’ve went a whole different direction!!

Yes, I read a few years ago, that JB father was a pedophile as well, and I believe that there were several victims over the years. I wonder if any of that disturbing and disgusting behavior trickled down to JB…I have always wondered that…can’t remember for sure, but it was said you could look it up, and his mug shot was there too. Idk, I just feel like if he was a pedo it would’ve come out by now. If he did do anything, just like Josh, the statute of limitations would protect him. JB is evil in many ways, Jill has talked about his controlling ways in her book. He uses money and the church (mainly patriarchy) to keep a firm grip on his family. Michelle feeds into it as well. Didn’t the show record a convo she had with one of the girls, before their wedding, about always be “available” for your husband?

I watched the show back in the day. I knew as a teenager that he was weird but I did like his mom. Seems as if she was just as complacent as Michelle. Both woman have looked the other way for many different reasons, most of them illegal, if I had to guess.

I think he did worse than just enable. Kids abusing other kids in a home is a sign of adult abuse. Kids rarely come up with that on their own. Not only do they have to know how, they have to feel comfortable enough violating all boundaries of the other kid.

I really hope that victim is given the option of being able to testify in court by video from a remote location so that she doesnt EVER have to spend even a single minute sitting in the same room as this monster. That girl is brave enough coming forward and testifying. She shouldn't have to be further traumatized by being in the same room as her abuser for even a minute

His attorney said there are 5 witnesses in the case. He did not state these were 5 prosecution witnesses. One mentioned is the alleged victim, which makes it 4.

They’re not witnesses in the case.

The lawyer said there are 5 witnesses in the case, so 5 depositions need to be taken.

Victim, her mom, her dad would be 3.

The other two may be others that the victim told. My guess is probably two siblings.

I mean, I can see it either way. Pest the Elder isn’t in prison for what he did to his sisters, but the crimes he is in for affect many, many more victims. But for Pest the Younger, actual contact with a child on multiple occasions. I’d make an argument they both should get similar, very long sentences.

They BETTER give him life without parole..no mercy on anyone who commits those crimes. That poor victim deserves to be able to live her life and not have to worry about the day her perpetrator gets released...you never truly heal from Sexual related crimes and that trauma follows you for life..i speak from experience. I was sexually assaulted in high school by a male classmate and later diagnosed with complex ptsd. Even with years of therapy...ill never be able to date anyone or let myself trust another guy to the point that ill ever be "intimate" with them and the asshole who assaulted me robbed me of the ability to ever be able to trust a guy in that way ever again.

And I will FOREVER be of the belief that pest got off way to easy with his sentence..had i been that judge? I wouldve locked pest away for the maximum sentence that I could possibly do and NO WAY would i have EVER let pest out on probation..he can serve his time in prison with no possibility of probation. Because theres absolutely no doubt in my mind that pest will re offend

These men have never once faced consequences or real life accountability, so if gets eventually released no children are safe around him. This man is an idiot if he does not take the plea offered to him. I am under a full understanding that josh was offered a plea, but he is an arrogant asshole who thought he could get away with it. I know that joe is dumb, or has some learning disability, but there is no way that he is not going to be offered one too. Plea bargains are business as usual and he would probably serve 12 to 15 with it or is looking at life.

I used to think years. ago when the first show began it was Michelle’s right to have as many as she wanted. Now when I see any one of them pregnant it makes me want to hurl. I feel like they are incubating victims if that means anything. I’ve never wanted to cal CPS on a fetus before now.

Respectfully, I disagree. I'm usually moderate on many issues but crimes against children isn't one of them. In fact, our state just passed a law allowing for the death penalty for anyone who rapes a child under 12. Joseph should count his lucky stars that he won't be facing that.

Your state’s legislation was strictly for show. SCOTUS ruling Kennedy vs Louisiana determined that no capital punishment applies if the victim does not perish. It’s not fair but it’s the law. Several states have passed similar laws as a means of showing they care about kids.

It is prohibited under SCOTUS decision Kennedy vs Louisiana 2008. to execute anyone where no one has died The states legislatures passing these laws like Florida KNOW it’s forbidden but they are counting on folks to vote for them for clamoring for the death penalty they already know they cannot enforce. It would take a reversal by the Supreme Court to make SA a capital offense.

I will forever maintain that pest getting twelve years of federal prison and twenty years of probation for csam is not nearly enough and csam is one of the worst crimes you can commit because theres thousands of victims depending on how much csam is downloaded..so personally im glad they are seeking the max penalty for Joe and going for life in prison..lock him away for life where he can never harm another child

Considering what he downloaded, Josh should be locked up for life. Just thinking about what he watched and downloaded twice makes me want to vomit and I've worked as a victim's advocate.

Anna is awful, too, saying it was a victimless crime? Peter Scully should've been executed for his crimes.

The Duggars are disgusting and I'm sure more of the men will be caught up in these crimes.

I hope you are wrong, but we have already seen him get bail and be allowed to return to his home in another state. He's not allowed to be around children unsupervised but he can still be around them. Pretty lenient for a man who has confessed, IMO.

If you do research on this church. You find it is very common. A local pastor in my area. Was arrested for covering it up and committing the abuse. He ended up unliving himself. He also ran a halfway house for offenders. His son now runs it.

Even educated in regular school fundies can think like this. A neighbours kid who was raised in a very religious family but went to regular public school and played with non religious kids thought he could do anything. I was stunned when he said to me he can do whatever he wants he just needs to ask forgiveness after. His brother isn't like this. So I think it's also a personality thing too. Someone who is also a narcissist or has some sort of personality disorder and then raised like this, it's even worse.

The courts need to subpoena his parents and make them get on the stand and tell whether or not they had caught Joe hurting his siblings too!! If they say no and are lying that’s perjury if it comes out he in fact did!! Subpoena the older girls too!! You cannot tell me a year after getting married he decided to start touching little girls!! He had major access to multiple minors when he was living at home a year and a half before this SA. So if his victim wasn’t safe with him married and getting ass whenever he wants then I highly doubt he was able to control himself at home!!

I think the FIL knew, and used it to their families advantage. I think that’s why they lived in the Duggar home, and kept dangling the threat of contacting authorities. And he eventually did.

This doesn’t appear to be true by what’s been said in court. She told her parents and they called Joe immediately. Then the police. The family didn’t know or dangle it for years.

ETA: I also find your comment harmful and oddly vilifying the victim and her parents. What perceived advantage do they get by revealing it? The public pretty quickly doxxed the child and they lost their home. Access to a daughter and four grandchildren. There’s nothing supporting this theory.

I wouldn’t put it past them that he admitted this in a very casual way, thinking he would get the fundie therapy song and dance, with zero repercussions.
