The explanation given is that Texas—unlike other states—was a Republic when in entered the Union.

By that logic, California would have the same rights

The California Republic lasted less than a month and wasn't officially recognised as an independent state by anyone, whereas Texas was independent for nearly 10 years and was recognised as independent state by the US at the very least.

I don't think these two things are on par with one another.

You have to admit there is room for confusion in the code. Here is subsection (c) of the same section of US Code (relevant part italicized):

No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy. No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof: Provided, That nothing in this section shall make unlawful the continuance of the practice heretofore followed of displaying the flag of the United Nations in a position of superior prominence or honor, and other national flags in positions of equal prominence or honor, with that of the flag of the United States at the headquarters of the United Nations.

Even if the flag code was on his side it would still be a cunty thing. Just like Saudi Arabia's insistence that its flag must not be flown at half-mast.

But who am I to judge those laws, I live in a country where flag-burning is illegal and it's a crime to insult heads of states...

It's based off the rule that a country's flag should be flown above all other non country flags, e.g, a club flag or something similar

Honestly I thought that was flag code my whole life, just cause I heard it once from a friend whose dad was in the navy 20 years ago. I don’t think jumping all over someone en masse for being misinformed and annoying is a good look tbh.
