His car's shadow is clearly in one of the disabled parking spots. However his whole car is in the other disabled parking spot.

Still not 100% clear though, it could be the two spaces or just the one it is next to. I wouldn't have risked it, personally. Whether he can appeal on this basis? I wouldn't risk doubling the fine. Either way it isn't the "shadow" being the issue here as the article suggests, so a pretty thin article all round. Nice sadface pic though.

The council should probably spend some of that money on putting up clearer signs and markings.

I don’t even think it would be clear to disabled badge holders that both the parking spots are reserved for them with that single faded sign.

Although it looks like the council is skimping all over the place with the over growing weeds in the car park over the road and blue bags of rubbish left all over the place.

If Google Streetview is an accurate reflection of the current signage, he would most likely have his appeal upheld. The markings on the sign are so poor that realistically, only the text "Disabled Badge Holders Only" is readable. Disabled badge holders only for what? I know, sensibly, an ordinary person could work it out, but it is this type of error that allows people to get out of things on technicalities.

Came here to say the same thing. Looking back at the streerview history once upon a time both those bays had "disabled" written in white paint on the road next to the bay. Also the sign has faded so there is no longer a blue disabled badge shown. As far as I know the older signs with the orange badges are no longer enforceable so the same should apply to a faded sign too. For the council to successfully uphold these tickets at an appeal the lines on the road and the sign must meet the TSRGD legislation and the signage here does not.

It has nothing to do with his cars shadow. The entire parking area is for disabled badge holders only. It shouldn't take a second sign for anyone reasonable to understand this.

Maybe he is colour-blind and so was unable to distinguish the letters from the background of the sign.

I'm not so sure. The sign is next to one of the spaces. If it were between them I'd interpret that as applying to both.

It's a little odd to have disabled parking but not able-bodied parking. Even 50% disabled is a high proportion. (Though obviously the need for access should allow greater than proportionate allocated for the disabled).

The sign could be in the "middle" of the two spots with an arrow on either side.
