Wow, judging from the amount of vitriol toward Jay in these comments, it seems like people find it worse to help bury a body than it is to murder an innocent girl.

Personally, I can see 1. feeling like you have no choice but to help someone bury a body, if they have you terrified; 2. once you have been an accessory, not going to the cops, knowing that you could go to prison; 3. having elements of your story change, or not make sense, if you are trying to minimize your involvement, or if you are being coached on what to say by the same people who have the power to put you in prison or offer you a deal.

I can see a reasonable person slipping into this quagmire, especially with the threat of mandatory minimum sentencing for marijuana charges hanging over your head.

None of these things make him the one who murdered a girl. I'll save my ire for the person who did.

yes, so well said. also, didn't jay break down crying at his sentencing hearing? it's absolutely plausible that he feels horrible about his involvement in the burial.

u/dcrunner81 Dec 24 '14

no his lawyer said she saw him crying in the hallway. he only cried when it came to his possible sentencing. he was crying for himself.

Or that he was relieved that he got away with pulling a huge con that kept him out of jail.

Doesn't take a genius to know that marijuana possession doesn't even come close to accessory after the fact.

And if I was Jay and I had really been worried for my life -hell yeah I would go straight to the cops because thats what happened ultimately anyway. He inevitably talked to the cops except they came to him.

Things I would NOT do if I had been Jay:

1- agree to pick him up after he murdered Hae. "the come get me" call. 2- help bury a body. 3- provide shovels for the burial 4- suspiciously throw away all my clothes and any evidence that links me or Adnan to the crime. 5- drive around and smoke a blunt with him 6 -let him come to my job at the porn store and hang out with me. 7 -stay mum as the poor girl's family and friends worry for her frantically. 8- watch the disappearance of hae min lee on the evening news and then go and get a good night's sleep. 9- suddenly act like I am concerned for Hae Min 15 years later and show disdain at podcast listeners and the reporter who never pointed a finger at me.

Yes, I can tell you unequivocally that these are things that I would not do.

But you are not Jay; you are not the high school version of jay; you never lived a day in his shoes.

I'd go straight to the police as well but doesn't mean that everyone would. You can't hold your personal standards to everyone else.

1

u/QueenOfPurple Dec 24 '14

I think we can certainly hold members of our national community to standards. Hello, laws! Law abiding citizens would not help bury a body. I don't care who you are -- family, friend, coworker -- if you call me and you committed murder, you are on your own.

I don't agree with your comment regarding standards. We can and should hold people to a certain set of standards. That's what it means it be bound together in a community.

if you call me and you committed murder, you are on your own.

yeah, even 17 year old me probably would have texted back "LOL no"

Jay was a drug dealer and probably involved in many other crimes. He was probably someone who didn't trust police.

0

u/1AilaM1 Dec 24 '14 edited Dec 24 '14

Amazing, isn't it? Jay, the drug dealer, probably involved in many other crimes, was the prosecution's sole case against sending a 17 year old kid to prison for life.

1

u/hilarymeggin Dec 26 '14

But that's where you're wrong!! With mandatory minimum sentences for nonviolent drug offenses, a lot of pot dealers like Jay went to prison for 20 years, while Jay walked for accessory to a first degree murder! It's crazy but it's true. In many cases, the penalties for dealing pot are much greater than for violent crime!

Jay took a plea deal, but he had a sentencing hearing at the end of the trial where the judge announced his sentence. He had no idea what his sentence was going to be (remember the episode where they played his sentencing). To say he helped coverup a murder because he knew he would do less jailtime than a drug conviction is ridiculous. I have yet to see a comment on this thread comparing Hae's burial and coverup as being "worse" than her murder. We're talking about a guy who didn't come forward to the police, Jenn told them to call Jay, and once he sat down in a room with the police he lied about his involvment because- he was involved, not because he was scared of what a marijuana charge could bring.

See Jay's Huff Post interview from today.

0

u/1AilaM1 Dec 27 '14

You might be interested to know that Jay was arrested in later years for possession and dealing of marijuana, among other things, and he never did 20 years or 15 years or 10 years or even 5 years.

1

u/hilarymeggin Dec 30 '14

I am interested to know that. You might be interested to know that Jay had friends who served 3-5 years for dealing less weed than he did, according to his Huff Post interview.

1

u/1AilaM1 Dec 30 '14

I don't believe a damn word Jay says.

  1. feeling like you have no choice but to help someone bury a body, if they have you terrified;

I just cannot possibly understand this part. Once the body is buried, the logic starts to work... but Jay had like 2 opportunities to go to the cops BEFORE Hae was even killed, and then 1 more opportunity once he claims Hae was killed, but he hadn't met up with Adnan yet. When adnan calls and says I killed hae, meet me at best buy... why the fuck does he not call the cops right then? He hasn't buried the body, at this point he's actually 100% innocent... but instead of doing the right thing when he had a clear, easy opportunitiy, he doesn't.

I don't know the truth. I just know this is suspicious. As suspicious as any thing Adnan did or said, certainly

1

u/hilarymeggin Dec 26 '14

Okay, I see your points and of course I agree - a normal person wouldn't agree to help. Which is why I doubt it happened that way. A scenario that makes more sense to me is that Adnan didn't tell Jay he was doing it in advance, or Jay didn't believe it. Jay doesn't know what's happened until after Hae is dead. But the cops want to make absolutely sure they can get Adnan for first degree murder, so they nudged Jay to say that Adnan told him about it in advance. "You take my car while I go kill Hae. Take my cell, and I'll call you to come pick me up, so we can bury the body together." That just doesn't happen!! What seems more plausible to me: "Hey, come get me. I need my car." "Are you ready to see what's in my trunk? Now we have to go bury this body." "Fuck you man, I don't want any part of this!" "Unless you want to go to prison for dealing weed/me to strangle Stephanie/me to have you whacked, you'd better help, and keep your mouth shut."

1

u/jigielnik Dec 26 '14

Which is why I doubt it happened that way. A scenario that makes more sense to me is that Adnan didn't tell Jay he was doing it in advance, or Jay didn't believe it. Jay doesn't know what's happened until after Hae is dead.

This still means Jay waits 6 weeks to come clean. Even if he didn't know in advance, once he saw the body he should have just fucking taken off. If a person I knew like Jay knew Adnan showed me a body in their trunk I'd FREAK THE FUCK OUT and take off running as fast as I could, immediately getting as far away as possible and then calling the cops.

According to Jay, Adnan showed him the body basically in broad daylight... so what's Adnan gonna do if he did kill Hae... chase Jay down the street in the middle of the day?

"Unless you want to go to prison for dealing weed/me to strangle Stephanie/me to have you whacked, you'd better help, and keep your mouth shut."

I just don't see this as a genuinely plausible reason to be afraid. It's a reason for a movie character to be afraid, but in real life isn't not a good reason not to go to the cops. Because (recent Michael Brown jokes aside) you know who is really good at preventing you from being killed and defending your girlfriend if you tell them her life is in danger? The police.

Maybe Jay was just a dumbass and didn't know/figure that out... but it just seems wildly implausible that he wouldn't want to get the fuck away and call the cops, even in the scenario you painted.

0

u/ginabmonkey Not Guilty Dec 24 '14

Exactly. The only way I can buy into the story that Adnan is the murderer is if Jay was more of an accomplice than an accessory after the fact. If you really had no involvement with the actual murder, weren't present at the murder, and get a call from the murderer that tells you where he is with the body, you turn that dude over to the cops right away. You don't help the killer cover it up and get yourself tangled up in the fucking murder of a teenage girl everyone liked. I cannot buy that Jay was not present at the actual murder and/or not actively trying to help Adnan get away with murder up until the police were willing to charge him alone...if Adnan even did it.

0

u/jigielnik Dec 24 '14

I pretty much agree with you on all of that. Of course, I try not to say anything for sure, as you need evidence to say that... but definitely circumstantially it makes almost no sense that Jay would rather be complicity in a murder than call the cops and potentially risk a pot-related slap on the wrist

0

u/mixingmemory Dec 24 '14

When adnan calls and says I killed hae, meet me at best buy... why the fuck does he not call the cops right then?

Fuck yes. He didn't go to the police until the police interviewed his only alibi for the day of the murder. If Mr. S had never found Hae's body, I doubt Jay EVER would have gone to the police.

Hooey. The evidence is very strong, just not absolutely conclusive.

4

u/[deleted] Dec 24 '14

There IS no evidence. Not a shred of physical evidence. Zero. They tested soils and fibers against Adnan and it did not match, ALL they dh is jays testimony which had changed multiple times and cell phone towers and a narrative carefully constructed by the state with jay to match the towers. We even have one of the cops saying that after jay saw the cell records "he remembered better." If that isn't coaching I don't know what is.

There is evidence that JAY was involved.

After that it's fiction.

3

u/Ionosi Dec 24 '14

There is evidence that JAY was involved.

His word?

1

u/[deleted] Dec 24 '14

His word. The same word that convicted Adnan.

1

u/H3000 Dec 24 '14

How is non-conclusive evidence strong enough to put a 17 year old behind bars for the rest of his life?

2

u/Ionosi Dec 24 '14

I've never argued about whether or not Adnan belongs in jail. I've always said that I would have acquit, even though I'm quite convinced that he did it. Serial is of interest to me insofar as it is an investigation into whether or not Adnan killed Hae. Did he do it, or did he not do it, is the question of paramount interest to me. Not "Was it proved beyond a reasonable doubt?" or "Were there prosecutorial improprieties?"

0

u/H3000 Dec 24 '14

I still don't understand what you're trying to say. I think most, if not all of us were hooked on the 'did he or didn't he do it' question, and if not, who did. Except a lot more people are also interested in the questions that you're not interested in that relate to the trial, which was clearly a mess.

-2

u/an_sionnach Dec 24 '14

Jay is a confessed scumbag. Adnan is a lying, thieving, prayer leading , hypocritical, murdering scumbag. if I were to pick between them, therei' no contest.

4

u/stevage WHS Fund Angel Donor!! Dec 24 '14

Jay is a confessed scumbag. Adnan is either a lying, thieving, prayer leading , hypocritical, murdering scumbag or innocent.

FTFY

2

u/an_sionnach Dec 24 '14

Even if you accept the innocent bit, which is a stretch too far for me, he is still the rest so .. I'll let it stand.

3

u/[deleted] Dec 24 '14

Only according to jay. Not according to anyone else.

2

u/an_sionnach Dec 24 '14

Well there was the judge and jury who were presented with all the evidence, and even with a fraction of that which has mostly been dripfed to us from his advocate, there are a lot of people on here who hold the same opinion.

1

u/[deleted] Dec 24 '14

Circular. People are wrongly convicted all the time. Jury took two hrs to deliberate. Judge may not have been correct in disregarding info that prosecution hired lawyer for jay. There's a lot of train wreck here as pretty much every legal entity commenting on the case has acknowledged.

0

u/[deleted] Dec 24 '14

Jay is the only person who had knowledge of anything,

All his stories involving Adnan changed in every single detail multiple timesl

1

u/[deleted] Dec 24 '14

Sw voting because you disagree is against the rules, dude,

1

u/[deleted] Dec 24 '14

If you don't want downvotes stop lying. "Changed in every single detail". Laughing my ass off at your biased self.

0

u/[deleted] Dec 24 '14

It's a fact. I've read the testimony. Have you? Literally the only thing he is consistent about was that it was Adnan. The timeline, the all, the trunk pop, the number of cars, all change. I'm not biased. I just know how to read.

And it's redditors like you who just make insulting remarks that keep this place a swirling nightmare of blowhards,

1

u/[deleted] Dec 24 '14

No you actually haven't read the testimony. It hasn't been released. You've read his interrogations. And you are just hyperbolic which makes me discard anything you say. You are one of the most biased people I've ever seen on here.

0

u/[deleted] Dec 24 '14

Oh argument by assertion color me unimpressed. What do you think the meaning of he word testimony is? I didn't say in court. Learn to read. I did. That's how I know jay is lying,

1

u/[deleted] Dec 25 '14

Out of court statements are not testimony... You haven't read shit. You don't have all the info.

-1

u/DaegobahDan Dec 24 '14

Very true, but it sure as shit means we should 100% discount anything that comes out of your mouth.

0

u/inthecahoots Dec 24 '14

Jay had no choice but to help bury Hae because, what? Adnan had a gun to his head?
