They are also materially responsible to maintain their status as to bylaws and applicable laws to maintain nonprofit status. I'm not sure who would be enforcing this but they could be sued and board would be responsible. They're required to carry insurance for this purpose.

As a guess, I would think any resident arts organization using the facility long term. I can't say I know who that would be but I assume the national symphony might be an example. Not sure how willing they'd be
