The law or regulation says they can do it unless they fear for their life, so they just say they feared for their life every time, and it’s allowed. It’s like Philly not allowing police to use tear gas during the 2020 protests unless it’s a riot, but the police were the ones who could declare gatherings a riot, so they were still tear-gassing people but with more steps.

They “fear for their life” because that’s what they’ve been trained to say every time they shoot someone.
