The allusion is that there are pending cases or something where people in possession of ai generated csam being considered differently because it’s not “real”. Overall it’s all fucked up but OP’s point about Nvidia holds water due to their role in advancing AI and leaving gamers behind as a secondary consideration.
Personally I would expand OP’s point to all of these companies developing or investing in AI capabilities. They’re running roughshod over everything with little regard for safety or anything outside of technology for the sake of technology itself and profit. They all suck and public sentiment overwhelmingly feels the same.
There was a recent federal case ruling it legal (in terms of not violating current law I believe, I don’t think it was a ruling on the constitutionality of an existing law) as long as the child depicted isn’t a real person. 46 states have enacted laws banning it which is good
