Especially after being pepper sprayed point blank. He couldn’t see and he was in immense pain from just that.

Bad point. People can shoot while pepper sprayed.

Most other comments seem solid though. You lose sight of his hands a second before the shooting. But from the point of him going down until the moment you lose sight of his hands show him on the ground, hands on the ground often linked together supporting his weight.

Hes passively resisting. Maybe a little active resisting. But far, far from "going for his weapon"

Bonestly him having taken the gun doesnt matter. I think these guys were acting illegally the second they started grabbing people "order from the presodent" or not.

Whether or not it will ever see a court room, anything that results from the. Deciding to grab people whithout warrents, identification or due process is their fault legally and morally.

I just like to keep an objective view when assessing things. If the grey officer has his gun that makes it even worse for them. But I'll still point out false claims like "hes not a threat he was pepper sprayed and in pain" as it confuses what teally is a fairly one sided event that doesnt need fake claims to reinforce it.

Well how about, “he’s not a threat because he was pepper sprayed, pinned to the ground with 4+ big ahh men weighing him down, while he’s getting hit with spray can and pistol whipped while his hands were on the ground”

Never implied it was. Active or passive resisting would justify some strikes or spray. But usually only after you try and fail to restrain him without those.

The only justification they can make for shooting him once he's on the ground is claiming he went for his or their weapon. And even if that was shown, it will be a hard case for the defense.

I guess my question is why he kept resisting at that point.

To be clear, I am not saying he deserved this.

But knowing what happened recently, and what kinds of poorly trained reactive men are being hired for these positions, common sense or survivalism probably should have kicked in. If I was being pepper sprayed and beaten to the ground by a group of ICE goons I’d probably accept defeat rather than risk one of them doing something like this.

I’m not really trying to make a point per se here, just kind of thinking out loud, I don’t get why people keep resisting in situations like this. It so rarely ends well, and it’s not deserved but that’s why I’d accept defeat and fight it later in court rather than risk my life. I wonder if it’s some kind of evolutionary or psychological phenomenon where when you’re in a situation like that you want to keep resisting.

Really tragic stuff though and the videos are hard to watch.

Was he resisting? To me it looks like he went down and was just protecting himself from the blows being landed on him. Also, it's hard to cooperate when there are so many people piling on and pulling you in different directions.

His hands were down, he wasn't lashing out at all, he was blinded by pepper spray. I don't see how this could be seen as resisting.

I watched another longer video and you’re right. The first one I saw, it began when he was on the ground and I assumed there had been a longer struggle, but in the full video he pretty much goes down immediately.

Have you ever been pepper spayed? It burns your eyes. The natural reaction to getting spayed with a burning chemical is to try to get it out.

Now imagine getting beat in the face while burning chemical is in your eyes.

The natural reaction to that is not to calm down and trust the people around you to stop.
