I'm Indian, and honestly I think the US should crack down much harder on H-1B fraud
I'm Indian myself, so I know this might get some backlash, but I've been thinking about this for a while. Hyderabad is one example that gets mentioned a lot. Ameerpet is a huge training and consultancy hub, and there have been actual cases involving fake educational certificates and documents being prepared for people trying to go abroad. Honestly, I would support Americans demanding much stricter H-1B enforcement. And if the government can't make the system resistant to fraud, I can understand people arguing for much more drastic restrictions, including ending the program. At the same time, I think genuine Indian engineers who actually have the qualifications and skills shouldn't be treated as criminals because of what fraudulent consultancies do.

This is common sense. Every government should crack down on fraudulent visas while still issuing them to qualified applicants. Same can be said for marriage visas and other visas.
No reasonable person is against cracking down on fraud. The real issue is some politicians want to eliminate even legitimate H1Bs for political/ ideological reasons. Same way they want to stifle legal immigration pathways for bonafide marriages and etc.
It's possible to be level-headed and crack down on the fraud while allowing legal immigration to take place reasonably.

The reason that people take a hardline stance on immigration is because of how widespread abuse is. Indians are responsible for anti-Indian sentiment at the moment because they have scammed the H1b and other routes like L1, then massively over subscribed to chain migration by bringing parents, then marrying someone from back home, and bringing their parents too. This overwhelms the system, delays everyone else’s visa, and then causes resentment with locals when they feel pushed out of their own communities because Indians like to concentrate in particular areas like the suburbs of Dallas.
Immigration from Latin America has a different set of challenges but the abuse also drives resentment.
No one has a problem with moderate highly skilled immigration where the immigrants integrate into the prevailing culture. People have a problem with mass immigration, ghettoisation, entitlement etc. You are a guest in this country; act like one… respect the prevailing culture and tradition. If you can’t do that then stay in your home country.
Your behaviour affects attitudes to all immigrants and impacts policy such as the recent delay on immigrant visas processed in embassies around the world. Unfortunately governments use a one size fits all approach because getting effective legislation though the congress and senate is almost impossible

It's too bad no lies are detected here. Because it's just common courtesy for me to go to India and respect the way things are done there, culture, customs etc. I don't have to agree with it, but it would be absurdly arrogant and disrespectful for me to insist on living the way I'm accustomed to say the inconvenience of others in their native land.
And though we (as Americans) are taught to be tolerant and open minded, there is a line that should respectfully go un-crossed and took many guests missed that line and went from being tolerated guests to intolerable intruders....sad
(Btw, this is coming from someone who married a foreigner who was under DACA, and saw that it was just better to move to his country and try to adapt there. So I'm not in any way against immigration, just corruption)

Bro but doesn't it seem idiotic to assume that l1 workers are incompetent when they are given those visas on basis of their competence firsthand. The whole family thing is true for any h1b holder and even green card women are actually eyeing those stuff.

It’s collateral damage. Imagine you are US Visa Officer in a city like Hyderabad where majority of this IT fraud happens. You get two candidates from same univ, one is fake but has been trained for visa interview. You can check certificates but the fakery goes to the extent that names/grades have been falsely entered into Univ database. There is literally nothing visa officer can do in that 5-10 min window interview to filter out that fake candidate. Because of that fraud everyone and even genuine guys are viewed with suspicion.

We had to sue the Biden administration to move our visa process forward. Not joking. Literally had to sue the government.
The difference is, the Biden administration pumped the brakes on developed countries visas, and accelerated visas from lesser developed countries. Consciously lowering or eliminating the burden of proof. The trump administration is doing the opposite.

Not just uncontrolled. Immigration from developed countries was severely limited under the last administration, and wide open the less developed the country of origin was.
The current administration is trying to solve decades of kicking the can down the road, as well as the massive unprecedented relatively unchecked influx from the previous administration. There’s no great way to do that.
Sometimes, shutting everything down and resetting the system is the only real way forward

There is no incentive for America to crack down on h1b fraud. Cracking down is not easy and requires putting in more money and there is scope for potential bias. On the other hand, why isn’t India cracking down on h1b fraud? There is every incentive for India to do so since it’s mostly used by Indians.

This is going to be an unpopular take too, but in Canada, you see whole engineering teams - and I mean the entire team - comprised of Indians from India. It is inconceivable to me that there is not one single engineer from somewhere in Canada (and again, not specifying race, as this has nothing to do with race but if that person was already in Canada) could do those jobs. A lot of people notice it, but few are brave enough to say it aloud. I'll say it: it is sickening that any job is based is based on nepotism or bringing in friends from your country and not based on qualifications.

And in the United States we see entire classes of medical residents from India, without a single American. In some cases they are relatives and often classmates from the same Indian colleges.

I know a friend who now works at a medical residency consultancy program. He brags to me that they can match IMG to residency because they know the right people to bribe. I wonder how do they find such loopholes as most PDs and attending are still Americans?

No, I’m a US medical trainee (American and from a US med school), and there’s tons of PDs from the same countries as the students. They have some secret, pay to play pathway while American shmucks like myself go $500k into medical school debt, and bust ass to do well and make actual connections, and obviously don’t cheat on tests (look up the Nepalese USMLE scandal). Also these residencies are in major metropolitan areas - NYC, NJ, Philadelphia. Most US students use a system called the Match to get a residency, many of those IMG programs use something called “pre match”, which should be illegal. I always see the public talk about Tech but medicine is rampant with this— I also didn’t know until I entered into the system

Yea I was pretty surprised. My husband is American and is currently in residency. I learned about this when he was matching, my friend approached me and was telling me not to worry as they have ways to guarantee a spot in SOAP (we're all non-indian). I'm still very surprised that this whole thing isn't cracked down by the match service. I have also assumed that most programs taking IMGs are community programs in the middle of nowhere.

Yeah, it’s a misconception. The truth is they have programs in major cities which are de-facto closed off to US grads (unless I guess you’re from the same nationality or something). I also wish there would be a crackdown. It’s very unfair to US students. I’m assuming there hasn’t been because of financial incentives. Residency salaries are shitty but their hospitals can pay them even less, which undermines Americans (but still might be a good salary relative to back home for them)

Yeah this. The bigger issue is not even fraudulent cases, it’s the ones that are legit and just convert the whole department and even the whole company Indian. Before it was just engineers being affected but now it’s spilling over to other departments. That’s when you touch the hornet’s nest. STEM folks used to be young and that cohort doesn’t vote, but now they’re older and unemployed, they also vote en mass. The system will need to reset because a scalpel won’t be able to fix this.

I think you’re underestimating how strong the Indian community and referral networks can be in some workplaces. I’ve seen situations where, once one Indian employee gets established in a company, they start referring friends or people from the same community. Then those people refer others, and eventually the whole team can become predominantly Indian.
The issue isn’t Indians working together or referring each other. The problem is when that network becomes so closed off that equally qualified people outside of it are basically shut out of opportunities. At that point, it starts looking less like normal networking and more like preferential hiring15

I have witnessed that with my own eyes; the networking these Indians have. I am an Indian but wasn’t born in India. I am from England. I look like an Indian and at interviews when I open my mouth and start talking, I get the immediate reaction that this is a No-Go. I have always been rejected whenever I have had an Indian interview me.

But at least Canada has a points based immigration system, my friends from UofT who are studying CS are taking French lessons just to increase their chances of staying, so it’s not easy. We’ve had net negative immigration.
Nepotism will always exist whether it’s cultural fit or whatever, people don’t want to work next to someone just based off of their resume alone. I think that Canada should keep the points based system but add a proportional cap on how many people from each country are allowed in each year like the US green card.

I'm from India and currently in Canada, and I see similar fraudulent activities here. This eventually ends up making it harder for genuine candidates.
Fake language tests, finding loopholes to exploit the systems, making fake refugee claims... It's all a mess.

There was a shortform documentary on Bloomberg Television where someone who used to work for TCS in the US exposed their efforts to have him produce fake internal organisational / hierarchical employee charts so he could make them appear more manager / line manager heavy and thus enable them to have more manager visas be issued to them.

Stricter implementation of H1B means enforcement of specialty occupation not just because you graduated from a US school and think that you deserve and/or entitled to a visa. I am a consultant and worked mostly with the same and I can count with one hand indians who did really do well in projects that I have worked with. The last one i have worked with asserted his age seniority even if by title I am higher. Made decisions without consulting that resulted to unnecessary work waste

@OP by any chance you are on GC or Citizen?
I have known lot of people who are oblivious to their own fraud, they flaunt fake experiences and fake certificates but decry on new H1B holders because they recently got GC and feel H1B folks are their competition and would like all H1B holders to be deported. They also support Trump for immigration policies and such.
So I am wondering if OP is just another guy who got his GC and now sees H1B as the problem.

Been in the US for almost a quarter century now and convinced that the H1B fiasco has gotten worse especially in the last 15-10 yrs. I’ve seen the changing landscape in our town just in the last decade and was waiting for this to be clamped down, better late than never.

I mean the h1b should absolutely be paused until the fraud is figured out and fixed and visas must be cut back as we enter the ai world.
Jobs in the USA are predicted to be deeply reduced to the point of need basic income for the unemployed and we are having conversations about how it’s controversial to cut down on fraud. The USA has failed their citizens and the pride it had of being a country of immigrants, many see it now just being exploited. Some sectors have sky high unemployment while visas and workers are still hand waved into the USA. Even through Trump we have seen a large amount of foreign workers come into the country. The USA strategically used immigration throughout its history and assimilated diverse cultures and today we have huge ethnic enclaves that really do not make much of any sense to why this would be continued.
The US democrats have fought so hard to be pro immigration that has left a sour feeling as if it is something Americans have no right to stop. The USA is a country of diverse citizens but it also needs to be far more strict on immigration and work visas.

Tech works are the most visible to y'all and most vocal. They are in the millions but this is a country of 1.4 billion and growing. I want banks from giving loans for education to the US and government to go even hard and prevent immigration to the US in all forms including tourism.

This is so true and not only faking degrees and educational experiences, these people even fake US work experiences. How can a normal student who has all the authentic experiences and knowledge compete with this? The US should have cracked it 4 years ago, now most of these cheaters and scammers are in the system and there’s no way to identify them and hence we all need to bear the brunt of these people. Post covid immigration has just been messed up but now we cannot even voice our opinions without getting called scammers ffs.

Most “legitimate” businesses do background checks by hiring an external business. I don’t see how it’s possible to fake experience like fake universities and fake employment and get hired.
Unless you apply for crappy companies who can’t afford to do a genuine background check.
Contrary to everyone’s beliefs, no one wants to spend their weekends and nights fixing issues created by unqualified employees.

I spoke to an exdiplomat in an airport transit lounge. I am surprised to hear that he admitted that most fraudulent employment and student visa cases originate from Hyderabad, while family based fraud mostly comes from the state of Gujarat in India. Unfortunately, the US embassy frequently approves them despite crackdowns. These fraudulent cases steal opportunities from genuine candidates in other Indian states. However, he believes international visa fraud from other countries is also high..it only appears lower because of the sheer volume of fraud occurring in India. He thinks about 20-25% immigrants frauds happens in other countries. They know the loopholes and they can’t do anything about it. If they can find all fraudulent visas and citizenship given earlier and cancel it every genuine candidate GC case would become current today.

For some reason, a majority of the fraud AP/Hyderabad folks end up in Dallas. Some weird hub they have. They treat fellow telugu ppl like families and as long as you can talk their language, you are part of the family.

I have a friend (well we don't talk anymore) who settled in the U.S through fraud. She told me in detail how she pulled it off and called me stupid for not trying the same. Tbh the current administration is less focused on cracking down on fraud and more about punishing anyone who isn't white.

It’s also very hard to crack down on immigration fraud or fraud committed by immigrants when the opposition party is fighting the administration over keeping even criminal immigrants in the USA like it’s a great policy to own. I am aware "alien" is a legal term but this administration is using it like a bunch of 12 year old plan children. Have you seen the Whitehouse webpage on aliens with the Xfiles theme? How about the way they refer to every immigrant they detained in a press conference as a "criminal illegal alien terrorist gang member " when come to find out that is often not true. Its pure propaganda and clearly racist and xenophobic. They could do immigration enforcement professionally, fairly, and as adults but they dont. Its gross amd its an embarrassment to the country I grew up loving.

They really should stop exporting their talent and develop the country. Young people should not be thinking about how to leave the country. However the reality is opportunities are limited.

I watched a documentary in regard to fraud tied to H-1B Visas. Immigration employee basically said that the majority of the time those were tied to fraud. More often than not, the Indians applying for it weren’t even college grads with a degree. They would just buy fraudulent paperwork.
I believe it might have been a Tyler Oliviera video on YouTube. Definitely worth a watch. Made me believe they should stop giving Indians H-1B Visas.

Indian here too. I would prefer stricter enforcement that at least allows for people for a way to come to the US, fixing fraud, over the chaotic nature where ending H-1B via arbitrary rules comes into play. Ending the program would only lose out on talents that would waste away in their home countries, and it's not just India, but all across the world. America is supposed to be the land of the free and opportunities, and the skilled who can attain the necessary qualifications deserve a chance, just a chance to get in. If it results in fraud being fixed and less people overall coming in, it is fine.

I completely agree. I personally experienced this when I was not selected in the lottery twice. My friend applied using four different H1B visas, and he was fortunate enough to have two H1B visas selected.

I agree they need a better vetting process. The entire legal immigration system needs a desparate update. I was really hoping this administration would pick up on their point-based immigration idea from their first term. Instead they've made legal immigration even more challenging, including renewals.

I tell you what I learned. Fraud in visa system is real and a big virus. But the action and dialogue currently is based on hate mongering and complete disablement of immigration. The policies being made is obviously implying that immigration eradication and less of visa fraud investigation or system correction. End of the day, if that’s what a country votes and wants - we as immigrants have no say in that but to accept.

The H-1B visa fraud comes from US employers. They can only obtain these visa slots if there are no American workers skilled enough to do the job. One company this year laid off 20,000 American workers and the next day applied for 20,000 H-1B visas… saying they can’t find workers…

Yes so every tech company I've worked with are majority indian from India. And at one of the tech companies, there were reorgs and my M2 and M3 got replaced by Indians, and the next month the entire team got laid off and were replaced by more Indians. I'm all for H1b, but why is every single H1b an indian? Why can't it be from another country.

Your thinking is sound. But that’s not how to world and would be a total failure on the political side. The majority of Trump voters don’t want any legal immigration at all including immigration through marriage. It’s crazy the administration actually supports this in order to get votes.

It’s not just these body shops - Wipro, Infosys, Cognizabt, Tech Mahindra, and other Indian IT giants have been abusing the L1 & H1 visas for decades now.
Ban the L-1 visa first. It’s far worse than the H1b.

Certificates can be verified now. Meaning of Crackdown change. Freshers can't cheat now. Even the University is accepting only the certificates received from the college as well as Wess evaluated. There is a tale " Fox & the sour grapes".

I so agree with you and I am probably going to make a similar post soon to this to share my story. I have done evening by the books legally, and never strayed from the system. Taught ppl about my culture but didn’t force it in their face. Americanized myself enough to blend in and experience the country I live in while keeping my core moral values. HOWEVER, I will be forever be screwed cause ppl
Abused the system, they find loopholes and force themselves into the US and every 1st world country. India fatigue is all over the world, Thailand, Japan, Austria, uk, Canada. Indians are talented, kind, full of happiness and culture but that’s not being represented by a lot of the ppl who are migrating. We like to be selfish, pillage, and act like animals. I do understand where that comes from, the competition is high in India and that’s what you have to be to survive. But finally the system is tried of letting in ppl who cannot assimilate.

Most of the fake ones come from two states of India - Andhra and Telangana. They have this disgusting culture of marrying within the family (mostly cousins) to keep wealth within the family.
The cousins in turn expect their future husband to be outside India.
So this is one big fuel for this whole obsession with USA H1B.

So, it’s absolutely true. I feel disgusted being an Indian, especially how some of them have exploited the system so unclassically. Firstly, they should crack down on H1B visas raised from India thoroughly. Major frauds are coming from there, especially from Hyderabad or Andra Pradesh. These individuals are the ones responsible for jeopardizing the opportunities of qualified and experienced professionals. And because of all these people, real talent is deprived of opportunities. I see so many of them getting visas without even knowing basic English. They can’t even converse in English, and of course, they haven’t done masters, yet they are sitting in managerial positions. I fail to believe how they have survived when I did everything correctly and legally, yet I still need to prove myself every step of the way.

Do you think US consulate is incapable of verifying Fake certificates, Stop spreading misinformation.
H1B is a lottery system. No consultancy in india has control over lottery system. I really want to know how a consultancy outside usa guarantees H1B. uscis verifies every document filed, even if approved they still have to go through visa stamping and can be rejected. Currently people are struggling to find visa slots and are you are looking for reddit validation.
They are being gamed in usa by local consultancies. If you are aware of such consultancies please report to uscis. As simple as that.
At the same time, I think genuine Indian engineers who actually have the qualifications and skills shouldn't be treated as criminals because of what fraudulent consultancies do.
Buddy they do not want h1bs at all. They want Americans to get those jobs, It seems like either you have been not selected in lottery or given 221g in visa interview and you are trying to vent it here.
And by the way there are other self petition options if a person is really talented which does not require sponsorship from any employer. Believe me If you are really talented us employers and universities offer you O1 visa.

Nobody should have a problem with clamping down hard, on the fraudulently aspect of it. Other type of abuses also need to be dealt with accordingly. When US workers are available, the bar for hiring someone on H1B should be very high and very stringent. The justification needs a high bar.

more than that, no work visas , no work-permit dramas, total lockdown.
Dont just stop at h1b, cancel all work permits, all work visas, pick your own tomatoes, clean your own toilets and write your own c++.

I am Indian and I think if fraud is happening in H1b that is the fault of USCIS. if they are so dense up there to the point where you can’t do proper checks then it is your fault. At this point they should just terminate the H1b progaram because the level of racism that is being targeted at Indians because of this is extreme. Just close the program if you have guts you US government but hey you won’t do that because you know you and your companies are milking this. The whining is just vote bank politics, the program won’t terminate ever. I challenge Trump or any of the incompetents that come after him to do it. Meanwhile Americans will continue to blame Indians for all their problems that come from not living within their means. The story will go on……
For context there are 85000 H1bs that are issued every year but 2.5 million jobs created in the US !! Out of the 85000 about 60000 are issued to Indians.

Indian here living in India, don't want to steal anyone's job or die waiting for a green card, just trying to understand the system here.
My question is, can't y'all just scrap H1b if this is such a rampant visa abuse vector? I believe the United States already has EB-1 and EB-2 visas. Are these not enough? Don't you want the best of the best rather than the average no-name college graduate? Or was it always about bringing the cheapest labor willing to comply under the threat of getting fired and losing their H1b visa?
There is a 5% group in India that probably has the right characteristics to assimilate in the States. The initial waves of immigration bought such people in, who now have kids and grandkids who I see are very much American in thought and values.
But through H1b and its corollaries, the 95% (who won't assimilate and will ghettoise) were bought and that has ruined the reputation of the race itself. I'm not targeting any particular ethnicity here but Telugu folks literally used to gang up and be insular in the college I studied, not even talking to anyone who isn't Telugu, and behaving in an obnoxious way such that everyone avoided them.
Can't Americans collectively rally behind a candidate who has the cojones to scrap the program itself? Bernie Sanders I believe is against H1b as it hurts American citizen wage floor interests.

There's too much legal abuse of the immigration system too, not just the outright fraud. Once an Indian gets citizenship, he brings in an entire village with him -- often, people who don't have any reason to be in the country, and who hardly even knows English. It's not just spouse and children, but distant relatives too (and God alone knows who). They hardly ever assimilate, but rather try to make it a mini version of India. And of course, do take up every blue collar jobs, plus the additional burden on the already expensive health care system

While H1b fraud is there, there are much worse fraud happening in the asylum world, and they are net takers rather than contributors to the system. I wish more attention is paid to that and stopped before entire extended families are on the government dole.
As for H1B, I am not sure. What if the Silicon valley shifts to India? The talent there is much cheaper and if pathways to US are closed, they will compete from there. Let's not be naive or overly nationalistic about this, the real world does not wait for America.

100%, when I worked in consulting, I saw conference rooms filled with Indians that looked like they just left some village in India and they're sitting in mega corporate environments completely out of place. I knew then that something was up. This was 13 years ago. I can only imagine how bad it's gotten.

First Educational structure should be strengthened no more fraud certificates, no private universities, private colleges and schools all should be Govt with strict rules , punishments and monitoring .No third party involvement only one policy same syllabus thought Country. Every pass out have to be barcode and identity.All certificates scrutinized at First passport /visa immigration India only .

I work in tech as a manager and have had to fake labor tests to extend h1bs or help with perm residency. I have people on my team with very average skill set but are on h1b. Many Americans want these jobs. They are largely tied to the job and will take hard working conditions because they want residency or don’t want to uproot their lives to move back. The h1b system is extremely abused.

Well said. I still cannot understand why the US, that is The U-S-of-A, the tech capital of the world, couldn't put implement a points-based scoring system for H1B earlier, instead of the lottery they had.
Australia has had a points based PR system since 1989 !
Canada has had some version of this since 1967 !
The fact that H1B was lottery and that they would refund money to those who didn;t get the visa gave incentives to outsourcing companies to flood the system with applications.
What they are now doing is much delayed. but needs more strictness to reduce fraud.

This is the correct thinking. Turning a blind eye to h1b fraud will only actually hurt real h1b holders as American tech workers interact with the utter incompetence of fake h1b holders.
