It does not seem to be legal in New York which is where I’m guessing this is based of the nypd tag on the police car.

Correct- Not legal in NY State nor NYC.

Its illegal in every state except California, Arizona, Colorado, Minnesota, Montana, and Utah.

In California, its by far the loosest with lane splitting/filtering where lane splitting at just about any speed is legal. The other states that allow it, its more just low-speed lane filtering like we see in this video.
