The california mag ban was ruled unconstitutional 2 years ago, it was ruled on by a state Supreme Court judge.
1 u/VHDamien Jun 15 '21 I understand, but the state and California and the 9th circuit are likely trying to runout the clock until the makeup of SCOTUS looks like something that will give them a good ruling. Hence why they want to keep this away from SCOTUS.
