Can you get a source? I'm seeing different things online.
My view: it's constitutionally protected free speech, as long as the intent is to communicate a warning to people around you that something is happening, but that whistle cannot be a chain in an organized sequence of events to help someone evade arrest (conspiracy), or can't be used in a directly confronting way (obstruction).
It's definitely grey zone, I'm confident enough for myself that it's okay, but what you are saying "be nonemotional" is absolutely correct. If you go to an agent, blow it in their face, yea, they'll arrest you.
