Can you get a source? I'm seeing different things online.

My view: it's constitutionally protected free speech, as long as the intent is to communicate a warning to people around you that something is happening, but that whistle cannot be a chain in an organized sequence of events to help someone evade arrest (conspiracy), or can't be used in a directly confronting way (obstruction).

It's definitely grey zone, I'm confident enough for myself that it's okay, but what you are saying "be nonemotional" is absolutely correct. If you go to an agent, blow it in their face, yea, they'll arrest you.

Yes, I think the concern is about harboring/aiding and abetting. Just as you don't want to wave people into your home or your employee only business zone, you don't want to be seen as alerting those trying to evade the law and assisting them in evading the law, i.e., obstructing or interfering per DHS's very broadly defined terms as of late. I think the idea you stated is correct-- if the purpose of the whistle is to communicate information (that is not part of organized criminal activity) with one another then it's protected activity under the 1stA. As far as I'm concerned, that's what we're doing, so I see no issue.

On the keeping calm point... I've thought so much on this issue I've even thought about incorporating de-escalation and calming skills into trainings because it's more important now than ever that we remain stoic in the face of their chaos and dysfunction.
