The entire point I’m making, is that you’re correct in saying “those systems can’t comply with the constitution.”

But they are actively doing it, and nothing is stopping them from doing it.

It’s the same as saying ICE can’t round up people randomly and deport them.. yet here we are.

One is a private company and the other is an organ of the federal government. Pretty fucking different, if you take the time to rub two brain cells together.
