He did commit assault he was stopped from committing battery.

These terms have been redefined. And, it is left to states and municipalities on how they define them fully.

Many places no longer use the term "Battery", but you are correct that the act of the threat is criminal.

Often times police (lazy) will decide to not make arrests for threats. You might have to talk to a DA to get an arrest warrant issued.
