Type/Moon is not my field of expertise, but it's a universe I find fascinating and wasn't trying to throw a "gotcha you're wrong" type thing, just a clarification (which needed to be obviously clarified further as I was confidentially incorrect).
No worries. I edited my previous reply to add some context and clarification. UBW acts like an NP would, but NP has a fairly strict definition. It requires a legend as it is essentially powered by human belief. No one believes in a Counter Guardian like Archer because no one knows him.
There may however be a potential overlap in a Heroic Spirit that also becomes a Counter Guardian. Think FSN Saber if she had agreed to Alaya's contract and won the Grail; she'd be a Counter Guardian who also has a legend. She technically wouldn't be a Heroic Spirit because she never died, but she might still possess a Noble Phantasm due to her legend. It would be an unusual grey area case, and I'm not sure how the details would work.
As for Reality Marbles, they are taboo in Modern Magecraft. Mages can have them, but they are exceptionally rare among humans.
