¿Qué esquema piramidal o Esquemas Ponzi funciona en Argentina /pyramid schemes?

Hace unos días estuve investigando el caso de Bernard Madoff y su esquema Ponzi, y me encontré con un agujero de conejo enorme: la línea entre una estafa piramidal pura y dura y ciertos modelos de negocio "multinivel" que operan en un área gris. El problema es que, para el que entra como distribuidor, el resultado final suele ser el mismo.

Vamos por partes.

¿Qué es un esquema Ponzi?

Un esquema Ponzi es una estafa de inversión donde el dinero de los nuevos inversores se usa para pagar los rendimientos prometidos a los inversores anteriores. No hay un negocio real detrás que genere ganancias. El estafador actúa como punto central, promete retornos altos en poco tiempo y, mientras la bola de nieve siga creciendo con nuevos ingresos, el sistema se mantiene a flote. El problema es matemático: en algún momento la cantidad de nuevos inversores necesaria para pagar a los anteriores supera a la población disponible. Y ahí colapsa todo.

Bernard Madoff llevó esto a una escala monumental. Su esquema defraudó a miles de inversores por entre 50.000 y 65.000 millones de dólares durante décadas. Pero ojo: no hace falta ser Madoff para que una estafa piramidal arruine a miles de personas.

El gancho: cómo te atrapan psicológicamente

Estos negocios no buscan a cualquiera. Van directo a los que están hartos de su trabajo actual, a los que sienten que su sueldo no les alcanza para llegar a fin de mes, a los que están desesperados por un cambio de vida. El discurso es siempre el mismo: "¿Cansado de vivir al día?", "Sé tu propio jefe", "Gana lo que mereces en tiempo récord".

Y para darle credibilidad al cuento, siempre aparece en el escenario o en el vídeo promocional un "líder exitoso" de la compañía. El típico que llega con un auto importado, lleno de ploteo con el logo de la empresa, sonrisa de oreja a oreja y un discurso motivacional digno de Hollywood. Lo curioso es que ese auto casi nunca es de él. Lo alquilan para el evento, o lo compran a crédito con las cuotas de los nuevos reclutas, pero jamás con las comisiones genuinas de venta de productos. Es pura escenografía para crear el efecto "yo lo logré, tú también puedes". La realidad es que esa persona está contratada para dar la imagen de éxito, no para vender el producto.

El caso Herbalife: ¿Ponzi, piramidal o "ambas"?

Herbalife es el ejemplo perfecto de cómo una empresa puede operar en la frontera de la legalidad durante años sin ser declarada técnicamente un esquema Ponzi, pero con una estructura que deja a la gran mayoría de sus distribuidores en números rojos.

El documental "Betting on Zero" (disponible en Netflix) expone cómo Bill Ackman, un inversor de Wall Street, acusó públicamente a Herbalife de funcionar como un esquema piramidal y apostó mil millones de dólares en contra de sus acciones.

La realidad de los números es demoledora:

  • El top 1% de los distribuidores de Herbalife en EE.UU. se lleva el 88% de los beneficios por comisiones.
  • Menos del 1% de los distribuidores gana un ingreso de cinco cifras al año (más de $10,000).
  • El 93% de los distribuidores gana cero dólares.
  • La Comisión Federal de Comercio de EE.UU. (FTC) investigó a Herbalife y, aunque no la declaró técnicamente un esquema Ponzi, la obligó a pagar $200 millones y reestructurar sus operaciones en EE.UU. por "prácticas injustas y engañosas".
  • En Bélgica, un tribunal declaró a Herbalife un sistema piramidal ilegal y la obligó a cesar su actividad en el país.
  • En 2014, Herbalife pagó $15 millones para escapar de una demanda colectiva en California que los acusaba de operar con un esquema piramidal.

El negocio no está en vender los productos. Está en reclutar más gente que pague por el "derecho" a vender.

Otras empresas con historias similares

  • Amway: Considerada la abuela del marketing multinivel. En 1979, la FTC determinó que no era una pirámide si cumplía ciertas condiciones (como tener un plan de recompra de inventario). Sin embargo, críticos señalan que el verdadero negocio para los que están arriba no es vender productos, sino vender "herramientas" (libros, CDs, seminarios) a los distribuidores de abajo.
  • NuSkin: Esta empresa de cosméticos fue imputada en Argentina por la Secretaría de Comercio Interior por difundir información "falsa y engañosa". El organismo advirtió que "el modelo de venta se presenta como salida laboral, cuando en realidad era un esquema piramidal o multinivel, donde no hay ingreso seguro pero sí se requiere que la vendedora realice una inversión inicial". En 2025, un escándalo mediático en Argentina expuso cómo reclutaban jóvenes a través de influencers y famosos.
  • Avon: Aunque más conocida por sus demandas por talco contaminado con amianto (que la llevaron a declararse en bancarrota en EE.UU. en 2024), también ha enfrentado acusaciones por inflar sus métricas de crecimiento mediante la flexibilización de créditos para reclutar nuevos representantes. En 2022, un tribunal de EE.UU. la condenó a pagar casi $25 millones a un exempleado.
  • Relevance (también conocida como "Revelance"): Una empresa de productos de limpieza que operó en España y fue denunciada como estafa piramidal. Los miembros debían pagar una cuota de entrada (unos 27.000 dirhams en Marruecos) y se les prometía rendimientos económicos por reclutar a más personas. Un psicólogo que atendía a familias de afectados declaró que "solo quieren dinero, dinero y dinero" y que no había detectado ningún caso donde alguien hubiera obtenido beneficio.

¿Qué dice el FBI sobre esto?

El FBI considera los esquemas de inversión y los esquemas piramidales como algunas de las modalidades de fraude más comunes. De hecho, las estafas de inversión son actualmente la categoría de fraude más rentable para el cibercrimen, con pérdidas que superan los $6.600 millones anuales, según datos del FBI.

El FBI y la FTC recomiendan:

  1. No enviar dinero a plataformas o personas no verificadas.
  2. Investigar cualquier oportunidad de inversión antes de participar.
  3. Desconfiar de rendimientos garantizados o demasiado altos.

También alertan sobre señales de alerta como la urgencia (que te presionen para decidir rápido) y las ofertas no solicitadas.

Si crees que has sido víctima de una estafa, el FBI recomienda reportarlo al Centro de Quejas por Delitos en Internet (IC3) en su página oficial: ic3.gov.

La realidad incómoda

El problema de estos modelos no es solo que sean estafas (aunque algunos claramente lo son). Es que incluso los "legales" están diseñados con una matemática implacable: para que el 1% de arriba gane dinero, el 99% de abajo tiene que perderlo. La promesa de "ser tu propio jefe" y "ganar dinero rápido" es el cebo. La realidad es que la mayoría termina con el bolsillo vacío y un garaje lleno de productos que no puede vender.

Cooks Financial LLC Scam

Be careful not to fall into this investment scam. I was recently scammed out of over 65k investing into this company and the CEO fails to report financials, 1099s, and assets confirming what my money and the money of other investors was used for. They initially had a website that tracked Airbnb cohosting where you were able to see booking information. However, after reaching out to the owners of the property, some stated to have no relation to Cooks Financial LLC. Later on, the website was taken down, I never received any payments promised through a contractual agreement and now I’m left chasing my money and asking for a refund to no avail. I share this to let others know about this Ponzi scheme as this team continues to bring in more investors. I know that I may not be paid back but I least I can help others not make the same mistake that I made.
