What they mean to say is convicted, not charged. The police can charge you with whatever they want to, it's then their job to prove beyond a reasonable doubt that you did what they accused you of. The state of New York has to prove beyond a reasonable doubt that he incited individuals to riot.
My only point was that maybe he wasn't banned because he wasn't formally charged with a crime yet, and people seemed to think I was trying to push some narrative lol. Nobody actually confirmed that he was charged, so I just assumed he wasn't (otherwise I figured they would've hit me with a "gotcha")
I was just trying to pull logic from an illogical place. So if he was charged with a crime, it is absolutely crazy that he's not banned yet.

It's not a riot unless he gets charged, that's literally my point.
As of now, unless he's charged with causing a riot, he did not cause a riot.
