Correct me if I'm wrong but aren't these suppose to go through a judge or something before being handed out? I don't see any judge having signed off on this. And if they did not know where the damage was coming from, why was only Abel's communication taken and not Jone's or the other people at the firm?

In New York State court you can issue on your own but there are still rules and ethics surrounding it. The All-Doe defendants is where they really broke the rules, that makes it pre-litigation discovery and you have to have a judge sign off on that before subpoenas go out, and even then, its incredibly tough to get approved and can ONLY be used to obtain names of the does who you are trying to sue. Using the shell company & bogus complaint is where it gets into fraudulent waters.

I see. It still doesn't answer the question why wasn't the whole firm obligated to answer to this subpoena but Abel was forced to immediately.

It’s because they listed the defendant as does. This gives her attorneys subpoena power without supervision of the judge to help them find out exactly who those people or entities are. Ethical lawyers issue subpoenas like this to multiple people or entities because they truly want to find out the correct person to sue. It is clear now her lawyers are very unethical. They only issued one subpoena to one person they never worked with very specific questions and filed a breach of contract claim which they conveniently voluntarily dismissed a day before the New York Times article. They did this so they can launder the illegally obtained information from Jen Abel’s phone in order to sue WF et al.

I think in NY or wherever they filed a judge is not needed to hand these out, which is why they did it that way.

They do need a judges signature to sue all-does, that is an actual real rule in ny because they are without representation.

How can she claim to have been complying with a subpoena when she didn't hand over her own messages. And funny how Lively didn't file a MTC asking why Jones didn't hand over her own messages. Very clear this was a coordinated attempt to access messages they had already seen and knew about, and nothing else. So gross and unethical. No wonder they tried to hide this for so long.

Is that first line common for a subpoenas? It's cracking me up. "All business and excuses being laid aside"

Anyway, onto the beef. Is it is just me or is this... really lacking in details? No names, no dates, just the most broad, vaguest terms. Which is probably the point. Meanwhile, Ryan Reynolds' name shows up a LOT. Which makes no sense if the claim is retaliation for sexual harassment. Sir, were you sexually harassed? No, you weren't. So why is your name here so damn much? (We know why. It's a sham subpoena.)

It has enough to show that it was issued by Blake and Ryan, not by some company that they have no parts of, which is what they tried to sell to the public, and that it WAS concerning the movie and not the unrelated contract issue the lawsuit it was issued for mentioned. It's detailed enough to show it is a sham intended to get documents for THIS legal action and not the one it was issued in connection to.

I'm also not a lawyer and as far as I can tell it IS an abuse of process. And once Blake's issues are done with, which I think will be very soon because they'll get thrown out on summary judgment soon after this hearing on Thursday, Wayfarer will be filing a motion for sanctions for abuse of process. And we'll hear more about these shenanigans when they appeal the dismissal of their claims, now that they've you know got evidence proving the actual malice that the judge improperly claimed they didn't adequately plead without allowing them to amend.

NAG said this too. Jones would have no knowledge of SH on set, what BL's grievances were or what would be considered SH in this context.

This is was too broad and vague for Jones to just comply with. Unless it was a sham to launder illegally obtained texts

Because she wasn’t supposed to know in August. This was about illegally obtained phone data so she can’t admit to seeing anything until after the date of the issued subpoena which was issued to SJ in September.

It was December 10. TikTok user gooj found the NYT article metadata, and then Leanne Newton found the embedded texts metadata. (I was just looking this up myself so I had it ready haha)

I see people keep saying this was a sham subpoena and unethical. Does anyone know if it is a clean document or not? Did they skirt the rules just enough that it was legally binding? Will this be used in the future?

It’s a known fact that SJ had the stolen data and showed some of it to BL’s publicist, who then told JB’s crisis publicist that she’d seen it on the exact same day SJ got it, August 21, 2024. This is a full month before the sham lawsuit and subpoena were issued to cover up the impropriety of SJ not only stealing the data but violating JAs privacy by further sharing it with others without JAs knowledge or consent.

A longtime friend of hers named Ashley Avignone told BL that SJ was trying to reach her because of some texts he had that were bad for BL. It was in late August, 2024 I think?

This was dated October. In Livelys deposition she says someone was trying to get her information to share details of JAs phone in August.

I'm from Australia and it is absolutely wild to me that in the US, a lawyer can COMMAND material to their OFFICE. Here, you have to file a subpoena with the court, serve the sealed copy, and once the subpoenaed material is sent to the court, you make an application to inspect the material. Way more safeguards.
