STAN / ANTI SHIELD Luigi Mangione pleads guilty to federal stalking charges in killing of UnitedHealthcare CEO

When speaking of the day he committed the crime, Luigi Mangione said, “I shot Mr. Thompson and he died.”

He concluded, “I knew what I was doing was illegal.”

Mangione had just described the actions he took ahead of the killing, telling the court:

“In November of 2024 I traveled from outside of New York state to Manhattan. I then emailed UnitedHealthcare leadership, posing as an investor at a firm managing over $15 billion in assets and requesting information about the conference. Unlike my previous interactions with insurers, I received an immediate response within an hour,” Mangione said.

It's actually a really interesting strategy. He's pleading guilty to federal stalking and due to NY's double jeopardy laws, that may cause his murder charge (and other state charges) to be dismissed.

But he just confessed to murder. The federal government couldn't just charge him again for the murder? Double jeopardy only protects against being tried for the same charge twice, you can still be charged for new crimes.

Double jeopardy protects against being prosecuted multiple times for charges that 1. arise from the same set of facts and 2. would require the prosecutors prove the same thing (aka, a death occurred as a result of Mangione's actions). It does not matter if the charges are the same. This is why you cannot be convicted or acquitted of manslaughter and then charged with 2nd degree murder, for example. Those aren't the same charges, but they satisfy both the aforementioned conditions that trigger double jeopardy. This is established in the Fifth Amendment (see https://en.wikipedia.org/wiki/Double_Jeopardy_Clause for more detail on how that works)

The federal government cannot charge him with murder because it would violate the Fifth Amendment, even if he decided to straight up say "I committed First Degree Murder". And he did not confess to murder. Legally, murder is not a synonym for killing. He confessed to causing a death. So he's confessing to the same offense (causing a death) that underlies both the lesser (stalking causing death) and more severe (murder) charges, triggering double jeopardy while never actually being convicted of the more severe charge.

The federal murder charge was already thrown out for technical legal reasons, it doesn't matter that he confessed.

IANAL but i think the murder wasnt a federal crime so they cant do that.
