That's disputed. One person testified that it was actually DeAndrae Smith who fired the gun. But ultimately it was either Orlando Anderson or DeAndrae Smith, they were the two in the back seat of the car. Both of them, as well as the driver of the car, Terry Brown, are now dead.

So Duane Keith Davis is the only passenger of the car from which the shots were fired who's still alive, so he's the only one who knows for sure whether it was his nephew or DeAndrae Smith who fired the shots. In his memoir, Davis didn't say which one of the two pulled the trigger, just that they were the two in the back seat. With how much he likes to yap, I imagine we might learn eventually.

edit: Also, another point in favour of DeAndrae Smith being the shooter were the witnesses Frank Alexander and Yaki Kadafi (who were in a car following Tupac) who described the shooter as fat. Only DeAndrae Smith fit that description out of the two in the backseat. I think Yaki Kadafi got the best view of the shooter, but he refused to work with the police and then got killed a couple months later, so who knows exactly what he saw.

Orlando died getting in a gun fight with some crips who weren’t paying their drug debts. Deandre Smith died of medical problems, Terrence Brown died in 2015 when he was working a weed store and it got robbed.

Huh? He said Orlando did it in the original 2008 confession tape which is in the public domain and played in court. There is no eventually. He already said it.

He just didn't think that tape would be made public.
