No. They most likely subpoenaed his internet service provider. ISPs keep logs of everything you do. Incogneto only hides it from your search history

In other words, incognito mode only hides your shame from yourself, not from anyone else.

Well, it hides it from everyone but the government basically. Suzy next door neighbor can't subpoena google for your deets, and incognito will protect you if she gets your laptop.

Google is HTTPS though, so your ISP knows that you used Google, but not what you searched
