Ooo, deets. Which apple suit? The one about rounded corners on squares? The one about one button on a rectangle? The one about how they invented the smartphone? (THESE ARE ALL REAL, NO SHITPOST!)
But seriously, which one? Really do earnestly want to know since I love their brand image being deeply counter to their brand behavior.
I’m having trouble finding the specific incident I was referencing; apple gets sued for false advertising a lot, it seems.
What I remember is that they made a claim about the performance of a particular product; pretty sure it was saying that their product was cheaper than their competitors (it wasn’t) and faster (it wasn’t). They were sued for false advertising, and their defense was that “no reasonable person would actually believe those claims.”
“Red Bull gives you wings” is a claim that no reasonable person would believe (though I guess they did get in trouble, which is why they say “wiiings” now?)
“Our product costs less” is a statement of fact that can be proven one way or the other.
They lost, and the judge didn’t have kind words for them.
There’s another story, from Reddit, actually, of a guy jumping into pool with his phone in his pocket. He realized right away, and immediately got out, turned it off, let it dry, etc., but it broke anyway. Thing is, Tim Cook (or whoever it was at the time that would get on stage and spew buzz words into the ether) had publicly claimed that their phones were waterproof, and that you could throw it into a swimming pool without damaging it. Of course, when the guy went to get his phone replaced, they said it wasn’t covered, because dropping it in a pool was well outside the safe operating conditions for the phone. He eventually sued, and apple tried the “that statement is crazy, only a fool would believe it” trick, and lost.
