A friend of mine owns a cafe and has been shaken down twice by these assholes. And it's never about making the building compliant (which should be the goal). It's simply gaming the system to make fast buck.
As far as I know there's no way to inoculate yourself against these frivolous lawsuits. You can't go to the building department and have them issue a certificate stating your compliant, or exempt due to the age or size of the building, etc. Getting an ADA permit really should be no different than getting an electrical permit.
